HomeMy WebLinkAbout249 - Santa Ana Avenue & Other ImprovementsAl RESOL'UrI011 OF THE BOARD OF TRUSTEES OF THE CITY OF NErPORT Bl;ACH, DECLARING THEIR INTENTION TO ORDER THE rMPFOMENT OF CERTAIN PORTIONS OF SANTA ANA AVENUE, OCE=AN DRIVE, TTXLFTH STREET ARD FOURTMITH STREET .WITHIN SAID CITY UNDER 'T HF IYPRMEMENT ACT OF 1911 AND THE,AMENDIWNTS TO SAID ACT. The Board of Trustees of the City of Newport Beach do resolve as follows: SECTION ONE That the public interest and convenience require, and it is th.- intention of the Board of Trustees of the City of Newport Beach, California, to order the construction of tre fol- loving described work and improvement in said city, to -wit: That Santa Ana Avenue in said city from the west- erly bQundary line of the City of Newport Beach to Fifteenth Street be graded, paved with concrete pavement, and have con - �ertein portions of said Santo, Ana Avenue strutted along_)FkKRaams conore a cur s, s Ming granite concrete.ornamental lighting posts, conduits, wires and apru rte- nances for the succe6bful operation of an ornamental lighting system. That Ocean Drive in said city from that portion of Santa Ana Avenue lying southwesterly of Ocean rrive to Twelfth • Ctreet be graded, paved -with concrete pavement, and have don- • strutted along certain portions of said Ocean rrive concrete curbs, also .installing granite concrete ornamental lighting posts, canduit6, vrire6 and appurtenances for the succa66ful operation of an ornamental lighting system. • • That Twelfth Street in said city from;Ocean Drive to Canta Ana Avenue be graded and paved, also installing of granite concrete ornamental lighting posts, conduits, wires . a.nd appurtenances for the successful operation of an ornamental lighting system. That Fourteenth 3trect in said city from Santa Ana tvenue to restminstcr Avenue be graded and paved, also installing of granite concrete ornamental lighting posts, conduits, wires and appurtenances for the successful operation of an ornamental lighting system. All of the foregoing work and improvement is fully Set forth, delineated and described on plans, profiles, cross sections and detailed drawings Noe 281 on file in the office of the City Engineer of said city heretofore approved by the Board of Trustees of the City of Newport Beach on the .9_,4 day of August, 1923, by Resolution No. 2, and in Specifications Yo. 33, adopted by Resolution No. 186 and.Specifications Ido. 33 adopted by Resolution $o. 165 of the Board of Trustees cf said city and on file in the office of the City Clerk of said city. The said plans, profiles, cross sections, detailed drawings and specifications are hereby referred to for the full, and detailed description of the said - proposed cork and improvement. SECTION TrO That the Board of Trustees also determines and declares that serial bonds bearing interest at the rate of seven per cent (7 %) per annum. shall be issued to represent each assessment of Twenty -Five (425.00) Dollars or more re- maining unpaid for twenty days after the date of the warrant. -a- - 3 • Said serial bonds shall extend over, a period ending nine (9) years from the second day of January next succeeding the fif teenth (15th) day of the next November following their date' Payments on the principal of unpaid aseessmer_ts and interest shall be made by property owners to the City Treasurer and the same shall be disbursed by him, all as provided in the`said Improvement Act of 1911, SECTION THREE That the contemplated work and improvement herein- before mentioned'is, in the opinion of said Board of Trustees, of more than, local or. ordinary public benefit, and the expense of said work and improvement is. made chargeable upon the district hereinafter described and said Board of Trustees does hereby .de- Clare said district to be the district benefited by said r ork and improvement and to be assessed to pay the costs and expenses there- of, which district is bounded and described as follows, to -wit: Beginning at the most vresterly corner of Lot 1, Block B, of a map of t:he.First Addition to Newport Heights -as recorded in Niscellaneous Maps,.Book 4 Page 94,_ Records of Grange County, ('alifornia; thence easterly and northeasterly along the southerly and southeasterly lines of Lots 1, 2 and 3, Block B, Park Y, and Lots 1 and 2, Block A of the aforesaid Map of First Addition to Newport Heights, to the most eaettrly cor- ner of the last mentioned Lot 1, Block A; thence northeasterly • in a direct line to the most easterly corner o.f Lot 5, Block 14, of theraforeseid Sap of First Addition to Newport Heights; thence northeasterly in a direct line to the most easterly corner of Lot 21.of the last mentioned Block 14;. thence southeasterly in a direct line to the most westerly corner of Lot 2, Block 25 of the - 3 .- s ` � • aforesaid Nap of First Addition to Newport Heights; thence southeasterly in a direct line t- a point in the southwesterly prolongation of the northwesterly line of Tustin Avenue, which f a ,�.. The above description is general only. A plat or map of said district No. 282 adopted by Resolution No. Zen of the Board of Trustees of said city, indicating by a boundary linez the extent of the territory included in the proposed district, is on file in the office of the City Clerk. Eaference is hereby made to said plat or map for a further full and complete description " of the said assessment district. The said map or plat so on file shall govern for all details as to the extent of the said assess— . ment district. SECTION FOUR Notice is hereby given that on Hcnday, the /O day of 1922, at 7:30 o'clock P. h., in the £:ouncil Chamber of the City Hall of the said City of Newport Beach, any and all persons having any objections to the proposed work or improvement or to the extent "of the district, or both, may appesr before the said Board of Trustees and show cause why.said proposed improve- ment should not be carried out in accordance,with this resolution. •. SECTIONS FIVE • The Kewport News, a weekly nwnspaper, published and circulated and of general circulation in the City of Newport Beach, is hereby designated as the nowspapar in which this Resolution of Intention shall be published; and the City Clerk of.said city is _ 5 - • hereby directed to cause thi" eBOIution of Intention to b. e published by two insertions 'in said newspaper it, the manner and form required by law. The Board of Trustees doei.not deem it advisable that the Clerk mail copies of the notice of improvement to owners or reputed owners and he is not required to mail the same. SECTION SIX The Street Superintendent of said city shall, after the adoption of said'nesolution of Intention, cause . to,. be conspicuously posted along the lines of said contemplated work or improvement, and along all the:Open street6 within the hereinbefore described assessment district, notice6 of the pas- sage of this Resolution of Intention in the manner and form re- quired by law, SECTION SEVEN ' All the proceedings for the aforesaid work and im- provement shall be had and taken under and in accordance with the provisions of an Act of the Legislature of the State of California, designated as-the "Improvement Act of 1911P, ap- proved April 7th, 1911,.and amendments t PLSSed and approved this y of ' 1923. r-1 L S J President of the Board of Trustees .
