GAUP. �i RESOLUTION NO. cS c3 OF THE CITY OF NEWPORT BEACH VaEREAS, the minutes of the adjourned regular meeting of the City Council of the City of Newport Beach, held the 10th day of June, 1929, show the following proceedings had and taken relative to Municipal Improvement District No. 7 of the City of Newport Beach, to -wit: "No written protests setting forth objections to t formation of the district, to the extent of the district, to the proposed work or improvement or to the inclusion of cer- tain property within the district having been filed with the City Clerk, it appeared to the City Council that all of the property within the described boundaries of the proposed dis- trict would be benefited thereby, and the Council did not deem it proper or advisable to make any change in the bound- aries, but that it had acquired and now possessed jurisdic- tion to proceed further in accordance with the provisions of the Act under which the proceedings were had." And WHEREAS,.said minutes do not show in detail and in full all of the proceedings had and taken at said time and place, relative to said Municipal Improvement District No. 7 of said City of Newport Beach, in this, to -wit: That said minutes do not show the following facts: That sworn evidence of R. L. Patterson, City Engineer of the City of Newport Beach, was received by said City Council that the petition filed with the City Clerk of the said City of Newport Beach, for the formation of said Municipal Improvement District No. 7, and duly presented and acted upon by said City Council, contained an accurate des- cription of the exterior boundaries of the proposed district; that the public improvement or work to be acquired and construct- ed as proposed by said petition, were and are necessary and that the district described in said petition would be benefited by the improvement proposed to be made therein, and that the property within said district and all of it would be benefited by said proposed improvement; that said proposed district was all within P 1 2 • 3 4 5 6 •• 7 8 9 10 11 12 15 14 15 16 17 18 19 20 21 22 25 24 25 26 27 28 29 50 51 52 ROLAND THOMP51 ATTORNEY AT LAW ...TA A., uuF. the boundaries of the City of Newport Beach; that said R. L. Patterson further stated that the estimated cost of the acquisition and construction and incidental expenses in connection with said acquisition and construction, was and is $36,000.00, and that all of the property within said district would be benefited by said proposed acquisition and construction of said proposed improvement. NOW, THEREFORE, BE IT RESOLVED. That the City Clerk of the City of Newport Beach, be, and he is hereby directed and instructed to amend the minutes of the meeting of the City Council of the City of Newport Beach, held on June 10th, 1929, by striking out the paragraph of said minutes above set out, and inserting in lieu and stead thereof, the following paragraph; t o%-wi t "No written protests setting forth objections to the formation of the district, or to the extent of the said district, or to the proposed improvement or work, or to the proposed acquisition or construction of the proposed improvement, or to the inclusion of certain property within the district, having been filed with the City Clerk of the City of Newport Beach, and no protest whatever, either written or verbal, having been presented to the City Council at said time, or at all, thereupon evidence was duly re- ceived from R. L. Patterson, City Engineer of the City of Newport Beach, that the petition filed with the City Clerk of the said City of Newport Beach for the formation of said Municipal Improvement District No. 7 contained an accurate description of the exterior boundaries of the proposed dis- trict; that the public improvement or work proposed to be acquired and constructed under said petition was a necessary improvement in said district and that the dis- trict described in said petition would be benefited by the acquisition and improvement proposed, and that all of the property within said district would be directly benefited by said proposed improvement, and further re- ported and advised said City Council that said proposed district was ali within the boundaries of the City of Newport Beach, and that the costs of the acquisition and construction and incidental expenses in connection with said acquisition and construction was $36,000.00, and that all of the property within said district would be benefited by said proposed acquisition and construction of said pro- posed improvement, and it satisfactbri ly appearing to the City Council after hearing said evidence so given by said City Engineer, the said City Council found that all of the property within the described boundaries of the pro- posed district would be benefited thereby, and that the -2- 32 ROLAND THOMPSC ATTORNEY AT LAW .PNTA A", CALIF. 1 proposed district was all within the bounaaries of the City of Newport Beach; that the public work and improve - • 2 ment to be acquired and constructed was necessary and a benefit to said district; that the district to be bene - • 3 fited by said public work and improvement to be acquired and constructed, is correctly described in said petition 4 and that the costs of the acquisition and construction and incidental expenses in connection with said acquisi- 5 tion and construction, to -wit, the sum of $36,000.00, is not disproportionate to the work and improvement to be 6 done and acquired and that all the property within the boundary lines of said district will be directly bene- 7 fited by said public work and improvement and the acquisi- tion and construction thereof, and that no one within said 8 district had, either in writing or verbally, protested to said City Council, nor had any protest been filed with 9 the City Clerk or otherwise, to the formation of said 10 district, or to the extent of said district, or to the proposed improvement or work, or to the acquisition or 11 construction of the proposed public improvement, or to the inclusion of his property within said district, and 12 the Council not deeming it proper or advisable to make any change in the proposed boundaries, therefore deter - 13 mined that it had acquired and possessed jurisdiction to proceed further in accordance with the provisions of the 14 Act under which the proceedings were had." 15 BE IT FURTHER RESOLVED: That as amended, the 16 minutes of the City Council of the City of Newport Beach of 17 June 10th, 1929, be, and the same are hereby approved. 18 19 20 I hereby certify that the foregoing Resolution 21 was duly and regularly passed by the City Council of the City of 22 Newport Beach, at a regular meeting thereof, held on the 4th day 23 of November, 1929, by the following vote, -wit: 24 /to- AYES, COUNCILNEN:.I��,�rG,,w1/A,�, 26 26 NOES, COUNCILIMN: 27" ,`' ABSENT, COUNCILMEN: 97.0- � SEAL)`" ATTEST: 30'' Clerk//Of the City of Newport Beach 32 ROLAND THOMPSC ATTORNEY AT LAW .PNTA A", CALIF.
