RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH, APPROVING.A CERTAIN AGREEMENT
OF FRANCHISE DATED THE 30th DAY OF NOVEMBER,
1928, FROM THE PACIFIC ELECTRIC RAILWAY COMPANY,
A CALIFORNIA CORPORATION, TO THE CITY OF NEWPORT
BEACH, AND DIRECTING AND AUTHORIZING THE MAYOR
AND CITY CLERK OF THE CITY OF NEWPORT BEACH TO
SIGN SAID AGREEMENT OF FRANCHISE ON BEHALF OF
SAID CITY OF NEWPORT BEACH, AND FURTHER DIRECTING
AND AUTHORIZING THE CLERK OF SAID CITY OF NEWPORT
BEACH TO ATTEST THE SAME.
WHEREAS, there has this day been presented to the
City Council of the City of Newport Beach a certain Agreement of
Franchise dated the 30th day of November, 1928, wherein the
Pacific Electric Railway Company, a California Corporation,
was named as the party of the first part, and the City of
Newport Beach, a municipal corporation of the County of Orange,
State of California, was therein named as the party of the
second part; and
WHEREAS, said Agreement of Franchise grants to
the City of Newport Beach, subject to the conditions in said
agreement set forth, the right to construct and maintain a high-
way upon and across the real property mentioned in said agree-
ment and belonging to the said Pacific Electric Railway Company,
a California corporation; and
WHEREAS, the City of Newport Beach has heretofore
paid an adequate consideration for said franchise to the Pacific
Electric Railway Company, a California corporation.
NOW, THEREFORE, BE IT RESOLVED: That the terms
of said agreement of franchise heretofore mentioned, be and the
same are hereby approved and accepted as presented; and
BE IT FURTHER RESOLVED: that the Mayor and City
Clerk of the said City of Newport Beach, be and they are hereby

authorized and directed to sign said agreement in duplicate
on behalf of said City of Newport Beach and that the City Clerk
of said City of Newport Beach be, and he is hereby authorized
to attest said agreement and affix the seal of said City of
Newport Beach thereto, one copy thereto so executed and signed
to be sent by the City Clerk of said City to the said Pacific
Electric Railway Company, and the other to be filed in the office
of the City Clerk of the City of Newport; Beach.
I hereby certify that the foregoing Resolution
was duly and regularly passed by the City Council of the City
of Newport Beach at an adjourned regular meeting thereof, held
on the 19th day of November, 1929, by the following vote,
