RESOLUTION NOS._ A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH DETERMINING THAT JOHN LOTH HAS WHOLLY FAILED TO CARRY OUT THE TERMS OF THAT CERTAIN LICENSE GIVEN BY THE CITY OF NEWPORT BEACH TO SAID JOHN LOTH THE 16TH DAY OF JULYt 1929. WHEREAS, the City of Newport Beach did by resolu- tion of its City Council the 16th day of July, 1929, grant to John Loth, a certain license, permitting him to have live bait for the purpose of sale and of selling the same upon the deck or floor of that certain wharf located in the City of Newpat Beach and which extends into and over the waters of the Pacific Ocean from the southerly end of Main Street, at Balboa, being the wharf erected by the funds of Municipal Improvement District No. l of said City; and WHEREAS, said license was given to the said John Loth upon certain conditions as shown by said license agreement heretofore mentioned and dated July 16th, 1929; and WHEREAS, the said John Loth has in -the judgment of the City Council of the City of Newport Beach, failed, neglec ed and refused to keep, perform and carry out all the conditions of said license or lease according to the true intent, meaning and spirit thereof, in this, to —wit; that said John Loth has violated condition "All of said lease by his failure to. maintain and keep on said wharf at a convenient and accessible place or places sufficient live bait to supply all the demands therefor by persons fishing as a pleasure or recreation from said wharf and said John Loth has further violated the terms of said licenE or lease in that he has failed to keep the floor or deck of said wharf in a clean, wholesome, sightly or sanitary condition and free from accumulation of refuse, in violation of Section °Bn of said lease; and Arroxxer I WHEREAS, the said John Loth has further violated • 2 the spirit of -said lease in this, to —wit: that he has been very 3 offensive to the people and public using said wharf and has been 4 insulting to many of the people using said wharf and has without 5 right or authority ordered anglers about and restricted the space 6 provided for the general public to fish.' 7 NOW, THEREFORE, BE IT RESOLVED BY THE CITY COUNCIL 8' OF THE CITY OF NEWPORT BEACH, as follows, to —wit: 9 Section 1. That the City Council hereby determineii 10 that John Loth who holds that certain license dated the 16th day 11 of July, 1929, with the City of Newport Beach, has violated the 12 terms thereof by his failure to perform the terms and conditions 13 of said license and lease in that said John Loth has wholly 14 failed to keep sufficient live bait on hand for the use of 15 persons fishing from the wharf heretofore mentioned and has 16 failed to keep said wharf in a neat, cleanly and sanitary condi- 17 u 18 using said wharf, and has assumed authority over the public 19 wharf which does not belong to him. That the City Council hereby determineii 10 that John Loth who holds that certain license dated the 16th day 11 of July, 1929, with the City of Newport Beach, has violated the 12 terms thereof by his failure to perform the terms and conditions 13 of said license and lease in that said John Loth has wholly 14 failed to keep sufficient live bait on hand for the use of 15 persons fishing from the wharf heretofore mentioned and has 16 failed to keep said wharf in a neat, cleanly and sanitary condi- 17 tion, and has been and is discourteous to the general public 18 using said wharf, and has assumed authority over the public 19 wharf which does not belong to him. 20 BE IT FURTHER RESOLVED: That that certain 21 'license* dated the 16th day of July, 1929, and given to the 22 said John Loth, be and the same is hereby terminated, and upon 23 service upon the said John Loth of a certified copy of this 24 resolution then sajd lib-ense "and all of the rights of said 25 John Loth under and by virtue olf said license'agreement 'shall 26 be immediately ended and terminated and the said John Loth shall 27 within five days after the service upon him of this notice, 28 remove all fishing gear and paraphernalia belonging to him and 29 used in connection with hissaid license from said wharf. 30 BE IT FUFG HER RESOLVED that a copy of this 31 resolution be forthwith served upon said John Loth by the Chief 32 of Police of the City of Newport Beach.
