HomeMy WebLinkAbout554 - Alley AbandonmentC >z RESOLUTION NO. 554. • A RESOLUTION OF THE CITY COUNCIL OF THE CITY Or 13E'o TORT BEACH, DECLARIZG THEIR IiiTr,iVTIOid TO • ORDER THE CLOSIi ?G UP AND ABANDOhliENT OF A CERTAIN PORTION OF THAT CERTAIN TEN (10) FOOT ALLEY IN BLOCK 1 OF EAST NE'dPORT; DECLARING IT TO BE FOR THE PUBLIC IiITEREST AN_D MIVENIENCE AND FIXING THL+ TIME AND PLACE FOR HEARING OB- JECTIONS TO SAID PROPOSED ABAivDOiaviENT. The City Council of the City of Newport Beach, pur- suant to the provisions of an act of the legislature of the State of California, known as "Street Opening Act of 188911, approved Larch 6, 1889, and amendments thereto, do resolve and declare as follows: Section 1. That the public interest and convenience requires the closing up and abandonment of a portion of that certain alley and as hereinafter described, in the City of Newport Beach, and it is the intention of the City Council of the City of Newport Beach to order the following alley in said City to be closed up and abandoned, to -wit: A portion of that certain ten (10) foot alley in Block 1, East Newport, as shown upon a map record- ed in miscellaneous iviaps, Book 3, page 37, records of Orange County, California, described as follows: Beginning at the southeast corner of Lot 12 of said Block 1; running thence northerly along the east- erly line and the northerly prolongation of the easterly line of said Lot 12 to an intersection with the westerly prolongation of the northerly line of Lot 13 of said Block 1; thence easterly in a direct line to the northwesterly corner of said Lot 13; thence southerly along the westerly line of said Lot 13 to the south - Westerly corner of said Lot 13; thence westerly in a direct line to the point of beginning. All of which is more clearly shown on a certain map approved and adopted by the City Council of the City of Newport Beacii for said _ • abandonment by Resolution No. 553, on the 9th day of December, 1929. Section 2. That the proceedings for the closing up 14 of the aforesaid alley shall be had and taken under and in 15 accordance with an act of the legislature of the State of 16 California, designated and known as "An Act to Provide for 17 Laying Out, Opening, Extending,- Widening, Straightening or 18 Closing up in Whole or in Part of any Street, Square, Lane, 19 Alley, Court or Place within Municipalities, to Condemn and 20 Acquire any and all Land and Property Necessary or Convenient 21 for that Purpose°, approved March 6, 1889, and amendments there - 22 to. 23 Section 4. TA ..I CAL1I. nia, and said newspaper is hereby designated for that purpose by the City Council, there being no daily newspaper published and circulated in said,City of Newport Beach, which said notice shall contain a statement of the fact of 'the passage of this Resolution of Intention, its date and briefly describing the work or improvement proposed, and referring to this Resolution for further particulars. Section 5. That any person interest objectirg to said work or improvement or to the extent of the district or lands to be affected or benefited by said work or improve - ment, and to be assessed to pay the costs and expenses thereof, may make written objections to the same within ten days after the expiration of the time of the publication of said notice,_ which objection shall be delivered to the Clerk of the City Council of the City of Newport Beach.
