• RESOLUTION OF THE CITY d6UNCIL OF THE CITY OF NEW-
PORT BEACH DIRECTING THE CITY CLERK OF SAID CITY TO
RE-ADVERTISE FOR BIDS 1OR THE IMPROVEMENT OF VIA
LIDO AND CERTAIN OTHER STREETS, EASEMENTS AND RIGHTS
OF WAY IN TRACT NO. 907 AS PER RESOLUTION OF INTENTION
N0. 513.
WHEREAS, the City Council of the City of Newport Beach,
California, did on the 15th day of July, 1929, receive bids for
the improvement of Via Lido and certain other streets, easements
and rights of way in Tract No. 907, all as particularly described
in Resolution of Intention No, 513 passed and adopted by the said
City Council on the 10th day of June, 1929, and the said City
Council did on said 15th day of July, 1929, award the contract
for said improvement to the UNDERGROUND CONSTRUCTION COMPANY at
the prices named in their bid for said work, and thereafter, pur-
suant to the directions of the City Council, the City Clerk of
said City caused a Notice of the award of said contract to be
published in the NEWPORT NEWS on July 25, 1929, and August 1, 1929,

WHEREAS, the said UNDERGROUND CONSTRUCTION COMPANY failed
to enter into a contract with the Superintendent of Street of said
City for the performance of said improvement within twenty -five
(25) days from the date of the first publication of the Notice of
Award, and i ii gg
WHEREAS, the property owners/naveef`Iled withtthe City
Council a letter requesting a re- advertisement for bids, and,
pursuant
to Section
13 of the Improvement Act
of 1911, as
amended,
the City
Council may
re- advertise and receive
bids at any
time
within six (6) months from the time set for the first reception
of bids;
NOW THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach as follows:

That the City Clerk 84 and he is hereby directed to
post conspicuously for five (5) days on or near the Council
• Chamber Door of the said City Council in the manner and form
required by law, a Notice Inviting Sealed Proposals or bids for
doing the work ordered as per Resolution No. 516 passed and
adopted by the said City Council on the 1st day of July, 1929,
and the said City Clerk is hereby directed to cause said Notice
to be published twice in the NEWPORT NEVUS, a weekly newspaper
published and circulated in said City and hereby designated
for that purpose by the City Council, a Notice inviting such
proposals or bids for doing the said work and referring to the
specifications on file; the said bids to be received by the
said City Clerk up to the hour of 7:30 o'clock p.m. of January
6th, 1930.
PASSED AND ADOPTED by the City Council of the City of
Newport Beach, California, at a regular meeting thereof held on
this 16th day of December, 1929, by the following vote, to -wit:
