RESOLUTION N0.
WHEREAS,. the Southern Counties Gas Company of
Oalifornia, did on or about the 27th day of January, 1923, file
in the office of the Oity Olerk of the City of Newport Beach
a certain bond, which bond is numbered 3048814; and
WHEREAS, said bond No. 3048814 was filed and posted
with the city of Newport Beach under the supposition that a
certain franchise for the right to eaecavate for, lay, construct,
maintain and operate gas pipes, mains and conduits for the
transmission and distribution of gas for heat, light, power
and other purposes under and along.all of the public streets,
alleys, lanes, highways and public places of and in said city
of Newport Beach, had been struck off and granted to said Sou
Counties Gas Oompany of Oalifornia; and
WHEREAS, said franchise was struck off to the said
Southern Oounties Gas Oompany of California, on the 14th day
of December, 1925, pursuant to Ordinance No. 254 of the Oity
of Newport Beach; and .
WHEREAS, under said Ordinance No. 254, bond No.
190441 was filed and posted with the City of Newport Beach
pursuant to and in accordance with said Ordinance No. 254; and
WHEREAS, it now appears that there has been a
duplication of bonds and that there is no necessity either for
the filing or posting of said bond No. 3048814, issued by the
Fidelity and Deposit Company of Maryland.
NOW, THEREFORE, BE IT RESOLVED: That the Fidelity
and Deposit Company of Maryland be, and they are hereby permitted
to withdraw said bond No. 3048814, and to cancel the same, and
upon said withdrawal and cancellation, said Fidelity and Deposit
Company of..Maryland, and the said Southern Oounties Gas Company
of Oalifornia shall be relieved of all further obligation or

obligations under the terms and conditions thereof.
I hereby certify that the above and foregoing
Resolution was duly and regularly adopted and passed by the
City Counoil of the city of Newport Beach at a regular meeting
thereof held on the lot day of January, 19349 by the following
