._ RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH, CALIFORNIA, DETERMINING THE "NATURE,
LOCATION AND EXTENT OF THE PROPOSED IMPROVEMENT
FOR THE CONSTRUCTION OF A WOODEN BULK HEAD AND
APPURTENANCES TO PROTECT CHANNEL ROAD AND OTHER
PROPERTY IN SAID CITY; GENERALLY DEFINING THE
BOUNDARIES OR EXTENT OF THE DISTRICT TO BE SPEC-
IALLY ASSESSED TO PAY THE COST THEREOF; AND DETER -
MINING THE STATUTE UNDER WHICH IT IS PROPOSED TO
CONDUCT THE PROCEEDINGS, PURSUANT TO THE PROVISIONS
OF SECTION 2 OF THE "SPECIAL ASSESSMENT I111lESTIGA-
TION, LIMITATION AND MAJORITY PROTEST ACT OF 1931."
WHEREAS, the City Council of the City of Newport Beach,
California, did on the 6th day of August, 1934, instruct the
City Engineer of said City to procure and prepare a written
report pursuant to Sections 2 and 3 of the "Special Assessment
Investigation,.Limitation and Majority Protest Act of 1931,"
as amended, and thereafter the City Engineer of said City
presented to this City Council the said written report; and
WHEREAS, pursuant to the provisions of Section 2 of
the "Special Assessment Investigation, Limitation. and Majority
Protest Act of 1931," as amended, the City Council must by
resolution or ordinance determine in general the nature, location
and extent of the proposed improvement; also generally define the
boundaries or extent of the district or lands to be specially
assessed to pay the cost thereof, or any part of such cost, and
determine the statute under which it is proposed to conduct the
proposed proceedings;
-NOW, THEREFORE, BE IT RESOLVED, BY THE CITY COUNCIL OF
• THE CITY OF NEWPORT BEACH, CALIFORNIA, AS FOLLOWS:
1. That the written report presented by the City
Engineer and herein referred to, is hereby approved, and it is

ordered that the same be filed in the office of the City Clerk
for public inspection.
2. That the proposed improvement herein mentioned is
more particularly described as follows:
The construction of a wooden bulk head and appurtenances
and appurtenant work adjacent and contiguous to the easterly line
of Lot M of Block P of Tract No. 518, as per map recorded in
Miscellaneous Map Book 17, Pages 33 to 36 inclusive, Records of
Orange County, California, between the easterly prolongation of
the southerly line of Lot 1 of said Block P and the easterly
prolongation of a line drawn parallel with and distant 14.50 feet
southerly from the northerly line of Lot 16 of said Block P, all
within the City of Newport Beach, California. The said construc-
tion and improvement of the aforesaid bulk head is deemed necessary
and convenient to protect the streets, public ways and other
property in the City of Newport Beach from overflow by water.
Reference is hereby made to Plan No. 399,attached to
and forming a part of the written report of the City Engineer
herein referred to, showing in detail the proposed improvement.
3. That the boundaries of the district or lands to be
specially assessed to pay the cost of said proposed improvement
are more particularly described as follows:
Beginning at the northwesterly corner of Lot 16
of Block P of Tract No. 518, as per map thereof
recorded in Book 17, Pages 33 to 36 inclusive, of
Miscellaneous Maps, Records of Orange County,California;
thence easterly along the northerly line of said Lot 16
and the easterly prolongation of the said northerly
line, a distance of 110 feet; thence southerly along a
line parallel to the easterly line of said Tract No.518,
to an intersection with the easterly prolongation of
the southerly line of Lot 1 of said Block P; thence
westerly in a direct line to the most southerly corner
of said Lot 1; thence northerly along the westerly line
of said Block P to the point of beginning.
