CALM. 4 of America WHEREAS, the United States has this day applied for a • 5 permit to erect, construct, maintain and use a temporary railroad 6 for the hauling of rock and other materials over and along 7 those portions of the public streets of the city of Newport Beach 8 more particularly described as follows: 9 A strip of land 8.'5feet in width along the following 10 described center line,` beginning at a point in the pro- longation of the northwesterly line of "B" Street across 11 Central Avenue, as said "B" Street and Central Avenue are laid out and shown upon a map of the Eastside Addition 12 to the Balboa Tract, recorded in Book 4, page 20 of Mis- cellaneous Maps, Records of Orange County, California, 13 which point is 29.25 feet northeasterly of the southwest- erly line of said Central Avenue; running thence south - 14 easterly in a direct line 130.13 feet to a point in the center line of said Central Avenue; thence southeasterly 15 along the center line of Central Avenue, as shown on said map of the Eastside Addition to the Balboa Tract and east - 16 erly along the center line of Central Avenue as shown on a map of Tract No. 518, recorded in Book 17, pages 33 to 17 36 inclusive, of Miscellaneous Maps, Records of Orange County, California, and southeasterly along the center 18 line of Central Avenue, as shown on a map of Tract No. 756, recorded in Book 23, pages 7 and 8 of Miscellaneous 19 Maps, Records of Orange County, California, and southerly along the center line of Channel Road, as said Channel 20 Road is laid out and shown upon a map of said Tract No. 518 to an intersection with the northerly *. line of Lot 21 J of said Tract No. 518. 22 And WHEREAS, said permit to erect, construct, maintain 23 and use said temporary railroad for the purpose of transporting 24 rook and other materials to the West Jetty in the city of 25 Newport Beach, has this day been granted by the city of Newport 26 Beach, by and through its city Council, upon the terms, condition 27 and specifications in said permit set forth. 28 NOW, THEREFORE, BE IT RESOLVED: That said permit to 29 construct, erect, maintain and use a temporary railroad along • 30 those portions of the city streets heretofore described, be and 31 the same is hereby granted to the said United States. -gf- America,i 32 ROLAND THOMPSON ATTORNST AT LAW SANTA ANA. CALM. 1 2 3 4 • 5. 6 7 8 9 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 servants, agents, employees, contractors or subcontractors performing the work of improvement herein mentioned, upon the terms and conditions specified in said written permit. BE IT FURTHER RESOLVED: That the Mayor and City Clerk of the city of Newport Beach be, and they are hereby authorized directed and instructed to execute, on behalf of the city of Newport Beach, a written permit granting to the United States,of America, its employees, servants, agents, contractors and subcontractors, the right to erect, construct and maintain a temporary railroad for the hauling of rock and other materials over and along those portions of the Newport Beach city streets heretofore described. BE IT FURTHER RESOLVED: That said written permit of America, be delivered to the United States( and to its proper authorities, together with a certified copy'of this resolution, by the City Clerk of the city of Newport Beach.
