RESOLUTION TO PERMIT DEPOSITING DREDGE MATERIALS 3 WHEREAS, the United States of America has this day applied 4 for a permit to deposit dredge materials on certain tide or sub - 5 merged lands, or other lands of the city of Newport Beach, in 6 connection with the improvement of Newport Harbor, by the United 7 States of America; and 8 WHEREAS, it is necessary that said dredge materials be 9 deposited seaward of the line of mean or ordinary high tide of 10 the Pacific Ocean, and to an elevation of twelve (12) to fourteen 11 (14) feet above mean lower low water, back to a point where the 12 fourteen foot .elevation intersects with the upland, and in 13 accordance with the plans of the City Engineer of the city of 14 Newport Beach, which plans have been approved by the City Council 15 of the city of Newport Beach and are on file herein; and 16 AREAS, it appears to the city of Newport Beach that 17 the improvement aforesaid contemplated by the United States of 18 America, will be to the advantage, benefit and best interests 19 of said city of Newport Beach, and that in order that said work 20 of improvement may be properly carried on and completed in 21 accordance with the plane of'the United States of America, it is 22 necessary that the city of Newport Beach permit the dumping of 23 dredge materials on certain of its tide or submerged lands, and 24 other lands of the city of Newport Beach, as in said written 25 permit set forth. 26 NOW, THEREFORE, BE IT RESOLVED; That said permit to 27 deposit or dump dredge materials by the United States of America, 28 in connection with the improvement of Newport Harbor as afore - 29 said, by the United States of America, be and the same is hereby • 30 granted to the said United States of America, its agents, 31 servants, employees, contractors and subcontractors performing 32 ROLAND THOMPSON II 1• ATTORN6 AT LAW BANTA ANA. CALIF. the work of improvement herein mentioned, upon the terms and oonditions speoified in said written permit. BE IT FURTHER RESOLVED: That the Mayor and City Clerk of the oity of Newport Beaoh be, and they are hereby authorized, direoted and instruoted to exeoute on behalf of the City of Newport Beaoh, a written permit granting to the said United States of Amerioa, its employees, servants, agents, oontraotors and suboontraotors, performing the work of improvement herein men- tioned, the right and privilege of dumping dredge materials, dredged from Newport Harbor by the United States of Amerioa, in the work of improvement herein oontemplated by said United States of Amerioa, on oertain tide or submerged lands and other lands of the oity of Newport Beaoh, as in said written permit set forth, and at the looations speoified in said written permit. BE IT FURTHER RESOLVED: That said written permit be delivered to the United States of Amerioa, and to its proper authorities, together with a oertified oopy of this resolution, by the oity Clerk of the oity of Newport Beaoh. I hereby oertify that the above and foregoing Resolution 11was duly and regularly passed and adopted by the City Counoil of the oity of Ne at Beaoh, at a meeting thereof held on the JL_day of 1934, by the following vote, to -wit: AYES, COUNCILMEN: u0i"PIa NOES, COUNCILMEN: U ABSENT, COUNCILMEN: Ab
