RESOLUTION NO. WHEREAS, the City of Newport Beach has heretofore committed itself to the United States of America and to the Orange County Harbor District, to furnish all necessary rights of way for the dredging and improvement of Newport Harbor, in accordance with the plans and specifioatione approved by the United States of America, and on file herein; and WHEREAS, the property hereinafter described is necessary for the work of improvement of Newport Harbor contemplated by the United States of America; and WHEREAS, the title,to the property hereinafter described is in the Title Insurance and Trust Company, a corporation, of Los Angeles, California; and WHEREAS, the said Title Insurance and Trust Company, a corporation, has agreed to sell all of its right, title and interest in and to said real property hereinafter described to the city of Newport Beach for the sum of Six Thousand Dollars ($6000.00); and WHEREAS, the City of Newport Beach is unable to pay the full sum of $6000.00 for said property; and WHEREAS, adjoining land owners have agreed to pay Twenty -five hundred dollars ($2500.00) on account of said p price, as and if the City of Newport Beach will pay Thirty -five hundred dollars ($3500.00) thereof; and WHEREAS, it appears to the City.Council of the city of Newport Beach that it is necessary that all of the hereinafter described property be acquired for harbor development purposes, and that said property and all of it is necessary for the complet development and improvement of Newport Harbor in accordance with the plans and specifications approved by the United States of America; and 1 2 3 4 • 5 6 7 8 10 11 12 13 14 15 16 17 18 19 20 21. 22 23 241 25 26 27 28 29 • 30 31 32 ROLAND THOMPSON ATTORNEY AT LAW BANTA ANA, CALIF. WHEREAS, the cost of said land to the City of Newport Beach is considerably less in the opinion of the City Council of the City of Newport Beach than said property is actually worth. NOW, THEREFORE, BE IT RESOLVED: That the City of Newport Beach purchase all the right, title and interest from and of the said Title Insurance and Trust Company, a corporation, for the sum of Thirty -five hundred dollars ($3500.00), all that certain real property situate in the city of Newport Beach, County of Orange, State of California, and more partiularly described as follows, to -wit: PARCEL 0A0 Of a parcel of land lying between filled ground of Park inson Island and the U. S. Government Bulkhead Line 50 feet north easterly therefrom, and extending from U. S. Sta. 170 to U. S. Sta. 175, and thence about'466 feet northwesterly, in Sec. 27, 28 and 34, T. 6 S., R. 10 W., S. B. B. & U., Orange County, Californ more particularly described as follows, to -wit: Beginning at U. S. Sta. 175 on the U. S. Government Bulkhead Line of the Survey of Newport Bay as shown on a map approved Jan. 18, 1917, by W.W. Ingraham, Assistant Secretary of War, on file in the.of.fioe of the U. S. Engineer, Los Angeles, California, from which the oorner common to Sections 27, 28, 33 and 34, T. 6 S., R. 10 W., S. B. B. & U., bears S. 370 151 410 E., 1572.22 feet, running thence along the U.. S. Government Bulk- head Line between Sta. 175 and Sta. 170, S. 610 001 E., 5176.30 feet to U. S. Sta. 170•, thence S. 230 001 W., along the U. S. Bulkhead Line between Sta. 170 and Sta. 171, 50.28 feet; thence N. 610 001 W. on a line 50 feet southwesterly from and parallel to the U. S. Government Bulkhead line between Sta. 170 and Sta. 175, 5293.36 feet to a point in the U. S. Government Bulkhead Lin between Sta. 174 and Sta. 175, which is 126.16 feet from Sta. 175 when measured on the aro. Thence N. 610 001 West on an extension of the last mentioned course, 85.95 feet; thence westerly on a curve concave to the south tangent to the last mentioned course with a radius of 140.71 feet, a distance of 237.32 feet to a point from which the radius bears S. 670 381 E., thence easterly on a curve concave to the south whose radius at the beginning of curve bears S. 670 381 E., and is 185.53 feet, a distance of 312.91 feet to a point in the northwesterly extension of the U. S. Government Bulkhead Line from Sta. 170 to Sta. 175; thence S. 610 001 E, along said extension, a distance of 153.23 feet to the point of beginning. PARCEL 0E0 Of a parcel of land in the area lying between filled ground of Parkinson Island and the westerly boundaries of Lot 5, Section 28, and Lot 1, Section 33, T. 6 S., R. 10 W., S. B. Government Bulkhead Line between Stations 174 and 173; thence northwesterly on a 5 curve concave to the southwest, and tangent to the last mentioned course, with a radius of 655 feet, a distance of 271.51 feet; 6 thence N. 510 151 W., tangent to the last mentioned curve, 313.87 feet; thence northwesterly on a curve concave to the northeast, 7 tangent to the last mentioned course, with a radius of 1115.53 feet, a distance of 469.54 feet; thence N. 270 081 W., tangent 8 to the last mentioned curve, 205.00 feet; thence northerly on a curve concave to the east, tangent to the last mentioned course, 9 with a radius of 538.00 feet, a distance of 464.80 feet • thence easterly on a ourvOyk'SaYfle south, compounding with the last to mentionecyourve, with a radius of 140.71 feet, a distance of 237.32 feet, to a point in the northwesterly extension of a line 11 50 feet southwesterly from and parallel to the U. Government Bulkhead 13 Line between Stations 175 and 174 which is 126.16 feet from Sta. 175 when measured on the aro; thence southwesterly alongthe 14 U. S. Government Bulkhead Line on a curve concave to the southeast and having a radius of 150 feet, a distance of 257.38 feet to the 15 point of beginning at U. S. Sta. 125 the corner common to Sections 27, 280 33 and 34, T. 6 S., R. 10 W., 8. B. B. & M., bear S. 470 32' 400 E., 3330.73 feet; thence from the point of begin- ning southeasterly on a curve concave to the northeast tangent to the U. S. Government Bulkhead Line, and with a radius of 498.40 feet, a distance of 291.41 feet; thence S. 610 001 E., tangent to the last mentioned curve, 479.64 feet; thence southerly on a curve concave to the west tangent to the last mentioned course and with a radius of 71.89 feet, a distance of 102.26 feet; thence southerly on a curve. concave to the east, reversing with the last mentioned curve, and with a radius of 788:00 feet, a distance of 417.11 feet to a point which is on the easterly extension of the north line of Washington Avenue of the City of Newport Beach; thence S. 890 151 30" W., along said north line extension, 125.58 feet to a point in the U. S. Government Bulkhead Line between Stations 124 and 125; thence N. 270 301 W., along said U. S. Government Bulkhead Line 1058.00 feet to the point of beginning. CALIF, r° 0 1 2 3 4 5 6 7 0 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 BE IT FURTHER RESOLVED: That the City Attorney of the City of Newport Beach be, and he is hereby directed and instructed to deposit with the Orange County Title Company, of Santa Ana, California, said Thirty -five hundred dollars ($3500.00), with instructions to the effect that said $3500,00 shall be used by sab Orange County Title Company, when they are able to deliver to the City of Newport Beach a quitclaim deed from the Title Insurance and Trust Company, a corporation, of Los Angeles, California, to the City of Newport Beach, to the property heretofore described, subject, however, to any and all matters of whatsoever kind or nature, now of record. BE IT FURTHER RESOLVED, that the claim and demand of the Orange County Title Company, for the amount of said purchase price, to -wit, $3500.00, be and the same is hereby approved, and the Mayor and City Clerk of the City of Newport Beach are authorized and instructed to draw a Warr`tsnt on the Treasury of the City of Newport Beach for said amount, and that said warrant be delivered to Roland Thompson, City Attorney of the City of Newport Beach, for the purpose aforesaid. I hereby certify that the above and foregoing Resolution was duly and regularly passed and adopted by the City Council of the city of Newport Beach, at a regular meeting thereof held on the let day of October, 1934, by the following vote, to -wit: 28 29' ':.. • 30.
