RESOLUTION NO.
WHEREAS, certain piers, wharfs and landings.construct
and operated by private individuals in the city of Newport Beach
extend over and upon city owned property; and
WHEREAS, those persons who have constructed wharfs,
piers and landings under permits issued by the City of Newport
Beach over, across and upon city owned property, are not paying
any rental to the city of Newport Beach at the present time; and
WHEREAS, the City Council of the city of Newport Beach
believes that those persons who have constructed wharfs, piers
and landings on, over and across city owned property, should pay
a reasonable rental for the use of said city owned property.
NOW, THEREFORE, BE IT RESOLVED: That those persons
who have constructed wharfs, piers or landings on, over and
across city owned property, shall pay as rental to the City of
Newport Beach, for th9fuse of the city lands upon which said
wharfs, piers or landings are built, the sum of $5.00 per year,
payable yearly in advance, commencing ad of the ]s t day of July,
1935.
BE IT FURTHER RESOLVED: That the payment of said
rentals do not in any manner or way give to said parties who have
constructed wharfs, piers or landings as aforesaid, on, over or
across said city owned property, any legal or other interest
whatever in or to said city owned property, and the city of
Newport Beach may at any time require the removal of said piers,
wharfs or landings aforesaid, by refunding to the owner of said
piers, vibarfs or landings, the unearned portion of said yearly
rental.
BE IT FURTHER RESOLVED: That said piers, wharfs or

landings may at any time be ordered removed in accordance with
the permit under which said wharfs, piers or landings were
permitted to occupy or use city owned property.
BE IT FURTHER RESOLVED: That said rental shall be in
addition to all other taxes of the city of Newport Beach.
I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the City
Council of the city of Newport Beach at a regular meeting thereof
held on the 5th day of November, 1934, by the following vote,
towit:
