J .. .. 6, & r 7 S' F-V -3'7.2 - -a`f- 'f3 1 RESOLUTION N0. 2 1 RESOLUTION ORDERING IMPROVEMENT 4 5 WHEREAS, the City Council of the City of Newport Beach 6 on the 17th day of February, 1938, passed its Resolution of 7 Intention No. 1286 to order the hereinafter improvement to be 8 made and public work to be done in the City of Newport Beach; 9 and 10 WHEREAS, after the passage and adoption of Resolution 11 of Intention No. 1286, the Street Superintendent of the City 12 of Newport Beach caused to be conspicuously posted along the 13 line of the contemplated work and improvement at not more than 14 three hundred feet (3001) in distance apart, and 20 1# all, 15 notices of the passage of said Resolution of Intention, headed 16 "NOTICE OF PUBLIC WORK ", in the manner, form and substance as 17 required by law, and said Street Superintendent also caused a 18 notice similar in substance to be published for four (4) 19 successive insertions, in NEWPORT NEWS, a semi - weekly newspaper, 20 printed, published and circulated in the City of Newport Beach, 21 and named by said City Council in said Resolution of Intention 22 as the paper in which said notice should appear, ear, all as appears 23 from the affidavit of S.A. Meyer, of the printers and publisher 24 of said semi - weekly newspaper, and which affidavit was filed in 25 the office of the Clerk of the City of Newport Beach on the 3rd 26 day of March, 1938, and is not on file therein; and 27 WHEREAS, the Street Superintendent of the City of Newport 28 Beach commenced the posting of the notice hereinbefore deferred 29 to on the 24th day of February, 1938, and fully completed the 30 posting thereof on the 24th day of February, 1938s as appears 31 from the affidavit of John A. Siegel, Assistant Street Superin- 32 tendent of the City of Newport Beach, and more than ten (10) \ y. ti ,A ..20 1 days having expired after the expiration of the time of the 2 publication of said notice within which protests or objections • 3 to the proposed work or improvement might be made by any person 4 interested objecting to said work or improvement, or to the 5 extent of the district or lands to be affected or benefited by 6 said work or improvement and to be assessed to pay the cost and 7 I expenses thereof; and 8 WHEREAS:, at the next meeting of the City Council after 9 the expiration of said ten (10) days after the expiration of the 10 time of the publication of said notice, two (2) written object - 11 ions to said work or improvement were filed, objecting to said 12 proposed improvement; and 13 WHEREAS, the City Council of the City of Newport Beach, at 14 a regular adjourned meeting held on March 21st, 1938, adopted a 15 resolution fixing April 4th, 1938, 7:30 o'clock P.M. in the 16 Council Chambers in the City Hall as the time and place for a 17 Public Hearing of said objections; and 18 WHEREAS, the said City Council }caving heard and consider - 19 ed all objections to said proposed improvement; and 20 WHEREAS, the objections of Mrs. Annie M. Stewart and 21 Robert S. Walker so filed, and after aforesaid }caving been duly 22 considered by the City Council were over - ruled, and each of them 23 was over - ruled, and the City Council of the City of Newport Beach 24 having now acquired jurisdiction to order the said improvement: 25 IT IS HEREBY RESOLVED AND ORHEERED: That the public inter - 26 est and convenience requires the work hereinafter described and 27 the City Council of the City of Newport Beach hereby ordere the 28 following work to be done and improvement made in the City of • 29 Newport Beach, as follows: 30 That that certain alley in Subdivision of Block "C ", 31 Newport Bay Tract,11is shown on a map recorded in Book 5, Page 25 32 of Miscellaneous Maps, Records of Orange County, California in the City of Newport Beach as hereinafter described be closed up ..20 1 and abandoned, to -wit: the office of the County Recorder of the County of 2 "All that certain alley 15 feet in width, lying southerly of add adjacent to Lots 14 to 17 inclusive, and easterly of and 3 adjacent to Lots 18, 19 and the northerly 14998 feet of Lot 20 • in Subdivision of Block "C ", Newport Bay Tract, as shown on a 4 map recorded in Book 5, Page 25 of Miscellaneous Maps, Records of Orange County, California." 5 6 All of which is more clearly shown on a certain map 7 ) approved and adop ta d by the City Council of the City of Newport 8 Beach for said abandonment by Resolution No. 1282 on the 17th 9 day of February, 1938. 10 The public work ordered and the improvement to be made 11 is for the purpose of closing up and abandoning of a certain 12 alley adjacent to Lots 14 to 20 inclusive in Subdivision of 13 Block "C ", Newport Bay Tract, as shown on a map recorded in 14 Book 5, Page 25 of Miscellaneous Maps, Records of Orange County, 15 California, in the City of Newport Beach, as hereinbefore des - 16 cribed,and for that reason no district is chargeable for costs 17 in connection therewith. 18 All of the herein proposed work shall be done in Bur - 19 suance of an Act of the Legislature of the State of California, 20 designated "Street Opening Act of 1889" and amendments thereto. 21 For further particulars reference is hereby made to said 22 Resolution of Intention No. 1286, which is dated the 17th day 23 of February, 1938, and on file with the Clerk of the City of 24 Newport Beach. 25 The Clerk of the City of Newport Beach is herewith in- 26 structed to record a copy of this Resolution Ordering Improve- 27 I sent, in the office of the County Recorder of the County of 28 f Orange, State of California. • 29 30 32 II -3m I • A �7 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15. - 16. . l7 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 1, 'Y I hereby CERTIFY that the foregoing Resolution order- ing Improvement No, was duly introduced and regu'hrly passed and adopted by the City Council of the City of Newport Beach at a regular meeting thereof held on the OrA day of OLD 19, by the following vote, to -wit: b NOES, C ABSENT, -4-
