RESOLUTION N0. I 3 A
WHEREAS, the City of Newport Beach, a Municipal
corporation of the sixth class_of Orange County, California, did,
pursuant to Ordinance No. of the city of Newport
Beach, execute and deliver a certain option or agreement to
purchase certain real property belonging to the city of Newport
Beach, to Ralph P. Maskey, for the consideration in said agreement
mentioned, and upon the terms and covenants thereof, which said
agreement with the said Ralph P. Maskey was duly and regularly
signed by the city of Newport Beach by its Mayor and City Clerk
pursuant to said Ordinance No.
of said city of Newport
Beach, on the 16th day of May, 1938, a duly executed copy of said
agreement being on file with the City Clerk of the city of
Newport Beach, and reference is hereby made thereto for further
particulars and the same is by such reference made a part hereof;
and
WHEREAS, the property mentioned in said Ordinance No.

and so sold to Ralph P. Maskey as aforesaid, under
said option or agreement to purchase, is described as follows,

All that certain real property situated in the city of
Newport Beach, County of Orange, State of California, and more
particularly described as follows, to —wit:

Lot 16, Block 438, Canal Section
Lot 17, Block 438, Canal Section

And 'WHEREAS, the City Council of the city of Newport
Beach only meets regularly once a month; and
WHEREAS, said properties above mentioned may be sold
from time to time by said Ralph P. Maskey, to various individuals
and said sales will necessitate in many instances the giving of
deeds and other instruments in writing.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
City Clerk of the city of Newport Beach be, and they are hereby
authorized, directed and instructed to sign, execute and deliver
on behalf of the city of Newport Beach all deeds presented by
the said Ralph P. Maskey, or his nominees, to the said city for
execution, and covering any or all of the properties heretofore
described, when the Clerk of said city of Newport Beach shall
certify that the price mentioned in said option or agreement to
purchase, has been fully paid, and the said Ralph P. Maskey has
paid the assessments and taxes on his part to be paid, under the
terms and covenants of said option. Said deed or deeds so to
be executed by said city to be clear and free of all encumbrances

1 of every nature, description or kind, except such encumbrances
2 made or suffered by the said Ralph P. Maskey under the terms
3 of said agreement, and the taxes and assessments on his part
4 to be paid or assumed as in said agreement provided.

I hereby certify that the above and foregoing
resolution was duly and regularly passed and adopted by the
City Council of the city of Newport Beach at an adjourned
regular meeting thereof held on the 16th day of May, 1938,
