CALIFORNIA RESOLUTION NO. WHEREAS, there has this day been presented to the City Council of the city of Newport Beach a certain agreement dated June 6th, 1938, between the City of Newport Beach therein called "Owner" and Donald Beach Kirby, therein called "Architect "; and WHEREAS, said agreement states that the Owner intends to erect a City Hall, Jail, Police Station and Fire Station in one or more buildings with such other accessory building or buildings as the Owner may see fit to erect in a Civic Center; and WHEREAS, the Architect agrees to perform for the above mentioned work, professional services as in said agreement set forth, the owner agreeing to pay the Architect for such services a fee of eight percent (8%) of the cost of the work with other payments and reimbursements as therein specifically provided, said percentage being therein referred to as the "basic rate "; and WHEREAS, said agreement specifically sets forth the conditions, consideration and terms under which said Architect is to perform the work in said agreement set forth; and WHEREAS, the City Council of the city of Newport Beach deems that it is for the best interests of said city that said agreement be entered into with the said Donald Beach Kirby, and that the provisions therein set forth are in all respects just and equitable. NOW, THEREFORE, BE IT RESOLVED: That the Mayor and City Clerk of the city of Newport Beach be authorized, instructed and directed to execute said Agreement in the name of and on behalf of the city of Newport Beach.
