A2, I! �'— WHEREAS, there has this day been presented to the City Council of the City of Newport Beach certain Escrow Instructions directed to the Orange County Title Company, dated July 4th, 1938, signed by Ralph P. Mackey and Irene Mackey, and covering Lot 4 in Block 338, Canal Section, Newport Beach Tract, as shown on a Map recorded in Book 4, page 98, Miscellaneous Maps, Records of Orange County, California; and WHEREAS, said instructions provide that the considers -. tion for the transfer of the above described property to the City of Newport Beach is the sum of $500900, payable in thirty days from date of escrow, and in consideration of which the said Ralph P. Maskey and Irene Mackey agree to convey said real property on the terms in said instructions reoited, from which the Orange County Title Company is instructed to deduct its charges and advances and also pay all encumbrances on said property necessary to issue Policy of Title Insurance showing title to said property vested in the new owner, free of all enoumbranoee, except City of Newport Beach taxes and Orange County Taxes, and all assessments for public improvements of record, whether due or delinquent, or otherwise, including 1911 Improvement Act bonds, it being understood and agreed in this connection that the city of Newport Beach takes said property subject to all taxes, city and county, whether delinquent or otherwise, and also subject to all assessments whethere due or delinquent, or which may become due in the future, including 1911 Improvement Act Bonds; and WHEREAS, said instructions further provide that the Orange County Title Company shall pay out of said $500.00, all city taxes and all delinquent installments on 1915 Act Bonds on Lot 8 in Block 539, and Lot F901- B3o. ok. '63.8, -Lot -3 -in ,BlpCk'339;.all AxoOdna7, Section, :3iewpgrt .Beach, and; 1 WHEREAS, said instructions further provide that if said 2 $500.00 is not sufficient to pay said taxes and delinquent install - 3 meats that said Ralph P. Maskey and Irene Maskeyv his wife, agree . 4 to deposit sufficient funds in escrow to pay the same; and 5 WHEREAS9 it is further provided that the City of Newport 6 Beach shall be at no expense in said escrow. 7 NOW9 THEREFORE9 BE IT RESOLVED: That the City Council 8 of the City of Newport Beach deems that the price paid for said 9 lot is the fair market value thereof at this time and that it 10 is for the best interests of said city of Newport Beach that said 11 city purchase said property for the sum mentionedv and upon the 12 considerations in said escrow specified; and 13 BE IT FURTHER RESOLVED: That the City of Newport Beach 14 will materially benefit from the purchase of said lot in as much 15 as it is contemplated and &greed that the said Ralph P. Maskey and 16 Irene Maskey, his wife, will exepnd said $500.00 in the payment of 17 delinquent city taxes on properties now owned by them and located 18 in said city, and all the moneys so paid for said lot by said city 19 will be returned to said city by way of the payment of delinquent 20 taxes as aforesaid; and 21 BE IT FURTHER RESOLVED: That the Mayor and City Clerk 22 of the city of Newport Beach be and they are hereby directed, 23 authorized and instructed to sign said escrow instructions in the 24 name of and on behalf of the city of Newport Beachq and the Clerk 25 is instructed to deliver the same into escrow with the said 26 Orange County Title Company as escrow holder. 27 28 I hereby certify that the above and foregoing � 29 Resolution was duly and regularly passed and adopted by the 30 City Council of the city of Newport Beach at a regular meeting 31 32 LAW OFFICES OF ROLAND THOMPSON 2, 210 SPURGEON BUILDING SANTA ANA.
