RESOLUTION NO.
WHEREAS, there has this day been presented to the
City Council of the City of Newport Beach a certain Agreement of
Purchase, dated the 26th day of May, 1938, wherein the General
Electric Company, a New York corporation is referred to as the
Manufacturer, and the City of Newport Beach, is referred to as
the Purchaser; and
WHEREAS, said agreement provides that the City of
Newport Beach desires to purchase incandescent lamps for the
period of one year from the date of said agreement, and pay for
the same in accordance with the terms and conditions of said
agreement, and the purchaser estimates that its purchases under
said agreement will amount to not less than $250.00 net value
in accordance with the manufacturer's current price schedules,
and the manufacturer accepts said estimate as a basis for billing
only and agrees to invoice the lamps covered by said schedules
at the following discounts from the list prices given in the
schedules, to -wit:
Discounts used as a basis for billing.
Standard Package quantity, 24%
Broken Package quantity on Mazda lamps only, 19%
And WHEREAS, the City Council of the city of Newport
Beach deems that it is for the best interests of said city that
said agreement be entered into in accordance with the terms and
conditions therein specified.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
City Olerk of the city of Newport Beach be, and they are hereby
directed, authorized and instructed to execute said Agreement to
Purchase, in the name of and on behalf of the city of Newport
Beach, and that the City Clerk deliver a duly executed copy
to the General Electric Company, manufacturer herein named.
