RESOLUTION NO.
WHEREAS, a certain agreement dated the AA L—
day of
s , 1938, by and between the City of Newport
Beach, therein referred to as Owner, and Donald Beach Kirby,
therein referred to as Architect, was presented to the City
Council of the city of Newport Beach; and
WHEREAS, said agreement provides that the Owner desires
to erect a Community Center Building.at Corona del Mar in the
City of Newport Beach, and further desires to retain said
Architect to perform professional services akin said agreement
set forth, for a fee of 8% of the cost of the work, with other
payments and reimbursements as therein provided, said percentage
being referred to as the "basic rate"; and
WHEREAS, the City Council of the city of Newport Beach
deems that it is for the best interests of said City that said
Architect be employed by the City of Newport Beach to perform
the work specified in said agreement, all as in said agreement
more particularly set forth; and
WHEREAS, the City Council of the city of Newport Beach
deems that the fee specified in said agreement is the fair
and reasonable fee to be paid for the services to be rendered
as in said agreement specified.
NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
City Clerk of the city of Newport Beach be, and they are hereby
authorized, directed and instructed to execute said agreement
in the name of and on behalf of the city of Newport Beach, and
that the City Clerk deliver a duly executed copy thereof to the
Architect therein named.
I hereby certify that the above and foregoing Resolution
was duly and regularly passed and adopted by the City Council of
