3 WHEREAS, a certain Deed - Highway Easement, dated the
4 day of September, 1938, from the City of Newport Beach, a
5 Municipal corporation of the State of California, to the State of
6 California, granting, conveying and dedicating to the State of
7 California for public highway upon, over and across all that
8 certain real property situated in the City of Newport Beach,
9 County of Orange, State of California, and more particularly
10 1 described as follows, to -wit:

A strip of land 20 feet wide, being the Westerly
12 20 feet of Lot 5 in Block °N° of Tract No. 323
as per map recorded in Book 14, pages 40 and 41
13 of Miscellaneous Maps, in the office of the County
Recorder of said County,

1511 was presented to the City Council of the city of Newport Beach,
1611 California; and
17 WHEREAS, the City Council of the City of Newport
18 Beach deems that it is for the best interests of said city that
19 said Easement be granted upon the terms and conditions therein
20 set forth, and other valuable considerations, including the
21 widening of Highway No. 101 through that portion of the City
22 of Newport Beach known as Corona Del Mar.
23 NOW, THEREFORE, BE IT RESOLVED: That the Mayor and
24 City Olerk of the city of Newport Beach be, and they are hereby

authorized, directed and instructed to execute said Deed - Highway
Easement, in the name of and on behalf of the city of Newport
Beach, and that the City Clerk deliver a duly executed copy
thereof to the State of California, Division of Highways.
I hereby certify that the above and foregoing
Resolution was duly and regularly passed and adopted by the
