HomeMy WebLinkAbout1460 - Districting Map,.ti 1 AM 1W 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. _ WHEREAS, the City Planning Commission of the City of Newport Beach did on the 29th day of November, 1935, at a regular meeting of said Commission, adopt by resolution a certain map designated "District Map "; and WHEREAS, said District Map mentioned in the previous paragraph, together with all matters shown thereon, was made a part of Ordinance No. 440 of the City of Newport Beach, passed and adopted by the City Council of the City of Newport Beach on the 6th day of January, 1936, as being a part of the master plan of the City of Newport Beach; and WHEREAS, said District Map heretofore mentioned is on file in the office of the City Clerk of the City of Newport Beach and reference thereto is made hereby for further particulars; and WHEREAS, the City Planning Commission of the City of New- port Beach did pursuant to advertising, postcard notice to adjoining owners and public hearings, all as required by law, recommend to the City Council of the City of Newport Beach by Resolution No. of the Planning Commission of the City of Newport Beach, that said District Map heretofore referred to be amended in a manner to show that the property hereinafter described be shown on said map as being in a 0-1 district rather than in an R=2 district as now shown by said district map afore- said, and that the hereinafter described property be re -zoned from an R-2 District to a 0-1 District. The property herein referred to is all that certain real property situated in the City of Newport Beach, County of Orange, State of California, and is more particularly described as follows, to -wit: A portion of Lot "F ", Tract 919, said portion being approximately 200 feet by 220 feet in size and lying contiguous to the State Highway and between same and Tenth Street. CALIFORNIA n .c. a And WHEREAS, the City Council of the City of Newport Beach did, pursuant to law, and said Ordinance No. 440 aforesaid, and the recommendation of said Planning Commission of the City of Newport Beach as aforesaid, call a public hearing on the question of changing said property heretofore described, from an R -2 District to a 0-1 District, as now shown by said district map aforesaid; and WHEREAS, the City Council of the City of Newport Beach did, at a public hearing, held on the 19th day of December, 1938, determine by resolution that said real property heretofore des- cribed should be changed on said district map aforesaid, from an R-2 District to a 0--1 District. Dated this 5th day o ecember, B. a City Clerk of the City of Newport Beach 1a l ORDINANCE NO. 479 AN ORDINANCE OF THE CITY OF NEWPORT B E A C H AMENDING SECTION 1 OF ORDINANCE NO. 431 OF THE CITY OF NEWPORT BEACH. The City of Newport Beach, by and through its City Council, does ordain as follows: Section 1. Section 1 of Ordi- nance No. 431 of the City of Newport Beach Is hereby amended to- read as follows: "The following charges shall be paid by all consumers in the City of Newport Beach, of water fur- nished to them by the municipal water system of the City of New- port Beach as follows, to -wit: METER RATES The monthly rate for water con- sumed through meters shall be as follows: For % inch meters, first 1,200 cu. ft. or less ............ $1.00 For rya incli meters, first 1,200 cu. ft. or less............ 1.00 For 1 inch meters, first 1,700 cu. ft. or less............ 1.30 For 12A inch meters, first 2,500 cu. ft. or less............ 1.78 For 2 inch meters, first 3,200 cu. ft. or less............ 2.20 For 3 inch meters, first 4,200 cu. ft. or less............ 2.80 For each additional 100 cu. feet and u to 7,700 cu. ft, per 100 cu. ft ....................... .06 For all over 7,700 cu. ft., per 100 cu. ft. .05 Water used for commercial or industrial purposes shall be sub- ject to special rates to be fixed by the City Council under sep- arate written agreement with the consumer. FLAT RATES When water is furnished not though a meter, a charge for each connection shall be made of $1.30 per month; provided that when the water is paid for annually in advance the charge shall be $12.00 per annum. Provided further, the City of Newport Beach shall have the right to install water meters on any and all water services and when meters are installed on water services, the charges for water used through said meters shall be in accordance with the meter rates hereinbefore set forth. When water Is to be furnished for a limited period of time and for any special purpose, the charges shall be the subject of special contract between the con- sumer and the City Council of the City of Newport Beach. Whenever the distribution line or lines of the municipal water system shall be duly connected with the premises of any person, natural or artificial, and the water turned on to such premises the charges for water shall be a charge against the premises; as well as against the person in pos- session of the premises who used the water, and in case in default of payment all charges for water and penalties shall attach to the premises and particular connection through which the water was fur- nished. And the charges shall continue so long as the water is turned on to said premises, whether the same is actually used or not, provided that upon written order of the owner of the premises, if all charges and penalties to date of said order have been paid, the water will be turned off and no charges made therefor during the time the water is turned off from the premises. All charges for water shall be payable on the first day of each month succeeding the month in which the water was furnished; every charge for water that is not paid by the hour of five o'clock P. M. of the tenth day of the month in which it becomes due shall be deemed delinquent and a penalty of five cents for each day thereafter that the same remains unpaid shall be added to the delin- quent charge, until the same is paid, or the water turned off from the premise . The Superintendent of the municipal water system shall, on or before the first day of each month, mail to each consumer whose premises are connected with the municipal water system, a true and accurate statement of the unpaid charges due the City of Newport Beach for water furnished to such premises, setting forth that unless said charges are paid on or before the tenth day of the month that the above prescribed penalties will be added, and that unless the delinquent charges and penalties are paid prior to the twenty -fifth day of the month the water will be turned off from said premises, without further notice, and will not be turned on again until all said charges and penalties together with a turn -on cost of $1.50 has been paid. At the close of business on the twenty -fifth day of each month the person in charge of the books of the municipal water system shall furnish to the Superintend- ent of the water system a list setting forth the premises, and name of the owner, upon which the water charges and penalties remain unpaid, together with the amount thereof, and it is hereby made the imperative duty of the superintendent of the water sys- tem, on the next business day, to turn the water off from said premises, and not to turn the same on again until all charges, penalties and a turn-on cost of $1.50 shall have been well and truly paid. Whenever the owner or occu- ;-w pant of nay premises previously connected with the city water system desires to be connected for water, hL shall make appli- cation for renewal of water service and pay therefor the sum of $1.50 before the water shall be turned on. The water herein agreed to be furnished at the rates herein specified, shall only be to con- sumers within the corporate lim- its of the City of Newport Beach, as to all others to whom water may be furnished outside of the city limits, and in accordance with the ordinance and statutes in such cases made and provided, sail outside consumers shall pay the same charges and rates as are being paid by them at the present time, and under the terms and conditions of their written con- tracts herein on file. All water furnished to consumers outside of the corporate limits of the city of Newport Beach shall be by contract in accordance with the statutes and ordinances in such cases made and provided, and in addition thereto, the meter rates and other rates shall be the sub- ject of a special contract between said outside consumer and the City of Newport Beach. Section 2. The above and fore- going ordinance shall be pub- lished once in NEWPORT BAL- BOA NEWS- TIMES, a semi- weekly newspaper of the City of Newport Leach, and shall take effect and be in force thirty (30) days after its passage. The above and foregoing Ordi- nance was introduced at a reg- ular meeting of the City Council of the City of Newport Beach held on the 5th day of December, 1938, and was finally passed and adopted on the 12th day of December, 1938, by the City Council at an adjourned regular meeting thereof, by the following vote, to -wit: AYES, Councilmen: Gordon, Claire, Whitson, Brown, William- son.
