RESOLUTION N0. 4
WHEREAS, there has this day been presented to the
City Council of the city of Newport Beach a certain agreement
dated the 19th day of December, 1938, wherein the city of
Newport Beach is the party of the first part, and D. K. Blue
is referred to as the party of the second part; and
WHEREAS, said agreement provides that the first party
leases to the second party certain property which had been
acquired the party of the first part for the widening of
'Central Avenue-1 in Newport Beach, and which the City of Newport
Beach does not at this time desire to use; and
WHEREAS, the City Council of the City of Newport
Beach deems that it is for the best interests of said City
that said property be leased to the party of the second part
upon the terms and conditions in said agreement more particularly
set forth.
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said agreement be entered into
with the said D. K. Blue, and that the Mayor and City Clerk
of the City of Newport Beach be instructed and directed to
execute said agreement in the name of and on behalf of the City
of Newport Beach, and that the City Clerk deliver a duly executed
copy thereof to the party of the second part.
I hereby certify that the above and foregoing Resolution
was duly and regularly passed and adopted by the City Council of
the City of Newport Beach at an adjourned regular meeting thereof
held on the 19th day of December, 1938, by t4lfollowing vote:
