RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH PASSING UPON OBJECTIONS
WHEREAS, the City Council of the city of Newport
Beach adopted its Ordinance of Intention No. 503, to order the
widening of Central Avenue between McFadden Place and "Ba Street,
which Ordinance of Intention was duly published as required by
law, the affidavit of publication being on file herein; and
WHEREAS, in said Ordinance of Intention No. 503
aforesaid, Monday, the let day of December, 1941, at the hour of
7:30 o'clock P. M. of said day, was the day and hour and the
Chambers of the City Council of the city of Newport Beach, in
the City Hall in the City of Newport Beach, was the place therein
fixed by said City Council, when and where any and all persons
having any objections to the proposed work of improvement might
appear before the City Council and show cause why said proposed
improvement should not be carried out in accordance with the terms
of Ordinance of Intention No. 503 aforesaid; and
WHEREAS, this is the time and place for the hearing
of objections to the improvement described in said Ordinance of
Intention No. 503 aforesaid, and to such objections as may be
filed to said improvement under the provisions of the Street
Opening Act of 1903; and
WHEREAS, the City Council of the City of Newport
Beach finds and determines that the affidavit of the City Engineer
of the city of Newport Beach has been duly filed and is on file
herein, showing that the assessment district described in

111 required by law, and the City Council further finds and determines

that the affidavit of the City Clerk of the City of Newport Beach

NOW, THEREFORE, BE IT RESOLVED by the City Council of the

notices to all persons owning property within the assessment
5
district described in Ordinance of Intention No. 503 aforesaids
6
as required by said Ordinance of Intention No. 503, and as provide

for by law; and

WHEREAS, at a time not later than the hour set for
9
said hearing, certain owners of land within the boundaries of the
10
of the property included within the Assessment District as

assessment district, filed protests in writing, objecting to the
11
improvement and to the extent of the assessment district; and
12
WHEREAS, careful consideration has been given to said
13
objections and protests and an opportunity has been afforded to
14
all persons desiring to be heard thereon, and a full, fair and
15
impartial hearing upon the entire matter has been had, and

evidence has been received relative to the area of the property

within the assessment district represented in the written protests
I8
filed and upon the other matters objected to;

NOW, THEREFORE, BE IT RESOLVED by the City Council of the

City of Newport Beach, and it is hereby found, determined and
22
ordered as follows:

(1) That the owners of only percent of the area
24
of the property included within the Assessment District as
25
described in Ordinance of Intention No. 503 heretofore adopted on
26
the 20th day of October, 1941, have made written objection to the
27
proposed improvement.

(2) That the owners of more than one -half of the area
29
of the property within the assessment district have not objected
30

or protested against the proposed improvement.

(3) That all of the protests and objections, both
written and oral, to the proposed improvement or to the extent of
the Assessment District, and /or protests and objections, both
written and oral, against the doing of the thing or things proposed
to be done in said Ordinance of Intention No, 503, are hereby over-
ruled and denied.
(4) That the district in the city of Newport Beach,
County of Orange, State of California, to be benefited by the
improvement mentioned and described in Ordinance of Intention No.
503 aforesaid, and to be assessed to pay the expenses thereof, is
the Assessment District particularly mentioned and described in sai
Ordinance of Intention No. 503, and reference is hereby made to
said Ordinance No. 503 for a description of the boundaries thereof.
(5) That the land necessary and convenient to be taken
for the improvement described in Ordinance of Intention No. 503,
is the land described in said Ordinance of Intention No. 503
aforesaid, and reference is hereby made to said Ordinance No. 503
for a description of the improvement and of the property proposed
to be acquired.
(6) That the City Council of the City of Newport Beach
finds and determines that it has acquired jurisdiction to order
the proposed improvement mentioned and described in said Ordinance
of Intention No. 503.
I hereby certify that the above and foregoing Resolution
was duly and regularly passed and adopted by the City Council of
the City of Newport Beach at a regular meeting thereof held on
the let day of December, 1941, by the
City Clerk
