RESOLUTION NO. � `' 1. C. -✓
WHEREAS, there is now pending in the Superior Court of the
State of California, in end for the County of Orange, action No.
being an action entitled, "City of Newport Beach vs.
John P. Hormen," and involving that certain real property situate
in the City of Newport Beach, County of Orange, State of Cali
more particularly described as follows:
Lot 28, Block 220, Section "A", in the City of
Newport Beach, as shown on a Map recorded in Book
4, page 21 of Miscellaneous Maps, Records of Orange
County, California.
And WHEREAS, the defendant, John P. Hormen, in said aoti
is the record owner of said real property; and
WHEREAS, the City of Newport Beach has been offered for
all of its right, title and interest in and to said real property
the sum of $1000.00; and
WHEREAS, in addition to said $1000,00 and as farther
Iconsideration for the right, title and interest in and to said
real property of said City of Newport Beach, the said John P.
IHormen has agreed to pay to Roland Thompson, as and for his
(`attorney's fees in this action the sum of $200.00; and
WHEREAS, the City Council of the City of Newport Beach
�ideems that said price is dust, fair and adequate for the interest
ch the said city may have in said property, and that it will be
2511for the best interests and benefit of said city that said city
2611dispose of its right, title and interest in said property in order

t said property may again be placed on the assessment rolls
e it will bear its dust burden of taxation.
NOW, THEREFORE, BE IT RESOLVED: That a certain stipulation
entered into by and between the plaintiff in said action and the

1 defendant, John P. Hormen, wherein and whereby said defendant
2 agrees to pay to said city the sum of $1000.00, and further has
3 agreed to pay the attorney' s fees incurred in said action to
4 Roland Thompson, plaintiff's attorney, in the sum of $ 200.00
5 and that title be quieted in said defendant on his cross - complaint,
6 subject, however, to the matters in said stipulation mentioned,
7 be and the same is hereby approved, and the Mayor and City .Clerk
8 of the City of Newport Beach are authorized, directed and
9 instructed to approve in writing the stipulation this day presented
10 to the City Council of the city of Newport Beach, on behalf of
11 said City of Newport Beach.

13 I hereby certify that the above and foregoing resolution
14 was duly and regularly passed and adopted by the City Council of
15 the City of Newport Beach at a regular meeting thereof held on the
16 Janaury
