CALIP. r` RESOLUTION N0, 2813 -a WHEREAS, FRANK MULLER, has made application to the City Council of the city of Newport Beach for a cancellation of taxes on the boat OLIVIA, No. 232441, owned by him on the first Monday in March, 1942, and docked in the City of Newport Beach, Orange County, California, on said last mentioned date; and WHEREAS, the said Frank Muller has represented to the City Council of the City of Newport Beach that said boat OLIVIA has been chartered by.the United States Navy for the duration of the war, and that he is receiving no compensation for this charter from the United States Government; and WHEREAS, said Frank Muller has asked for a cancella- tion of taxes on said boat OLIVIA for the reason that it is now property owned by the United States Government; and WHEREAS, Sections 4986 and 4986.2 of the California Statutes of 1941, provide in substance that all or any portion of any uncollected tax, penalty or costs heretofore or hereafter levied, may, on satisfactory proof, be cancelled by the officer having custody of the records of the city on order of the governing body of the city, with the written consent of the City Attorney, on property acquired after the lien date by the United States of America; and WHEREAS, the City Council of the City of Newport Beach has obtained satisfactory proof of the fact that said boat OLIVIA was on or about April 15, 1942, chartered to the Navy Department of the United States Government, and the United States Government now has sole custody and control of said boat and will continue to have sole custody and control of said boat for the duration of the war; and 1. L J 1 W iEREAS, it likewise appearing that the City Council 2 of the city of Newport Beach has the right under the Statutes 3 aforesaid, to cancel any portion of the tax lien on said boat 4 OLIVIA by reason of the facts aforesaid, and that the City 5 Attorney of the city of Newport Beach has consented to such 6 cancellation. 7 NOSY, THEREFORE, BE IT RESOLVED: That the Auditor 8 of the City of Newport Beach be, and he is hereby authorized, 9 directed and instructed to cancel fifty percent (50%) of the 10 taxes now due and owing from Frank Muller, to the city of Newport 11 Beach, on the boat OLIVIA, for the fiscal year 1942 -1943. 12 13 I hereby certify that the above and foregoing resolu- 14 Lion was duly and regularly passed and adopted by the City Council 15 of the City of Newport Beach at an.adj6urned regular meeting 16 of the city Council of the city of Newport Beach, held on the 17 10th day of July, 1943, by the following vote, to -wit: 18 19 AYES, COUNCILMEN: V►G,etl, Yli -01 � FS�1P�( 20 . _ y\Akl' 21 NOES, COUNCILMEN: nOStP- 22 ABSENT, COUNCILMEN: s 23 "TT.EST: 24 25 27 28 29 30 31 32 LAW OFFICES OF ROLANO THOMPSON 210 SPURGEON SLOG.
