RESOLUTION N0. � � V--
WHEREAS, D. W. ELLIOTT of Long Beach, California, has
applied to the City Council of the city of Newport Beach for an
agreement to drill for oil, gas, tar, petroleum or other hydro-
carbon substances in and under a certain area in the City of
Newport Beach, in accordance with the ordinances of said city;and
WHEREAS, the application of the said D. W. Elliott for
said agreement as aforesaid, contemplates the drilling for oil by
whipstocking or slant drilling from lands under lease by the said
D. W. Elliott, and lying outside of the city limits of the.city of
Newport Beach; and
WHEREAS, the said D. W. Elliott has a lease on-certain
real property for the development of oil, gas and other hydro-
carbon substances, which said real property is located outside
Of the city limits of the city of Newport Beach; and
WHEREAS, in the opinion and judgment of the City
Council of the city of Newport Beach the said D. W. Elliott is a
competent and capable oil operator and financially able to develop)
the oil lying in and under the tidelands belonging to the city of
Newport Beach; and
WHEREAS, it is further the opinion and judgment of the
City Council of the city of Newport Beach that the said D. W.
Elliott may conveniently develop said city's tidelands, which the
city may have available and which it may desire to have developed
for oil development purposes by subterranean drilling from said
D.W.Elliottle lease outside the boundary lines of said city; and
WHEREAS, it is further the judgment and opinion of they
City Council of the city of Newport Beach that the said city will
be placed at considerable expense in connection with the sub-
terranean drilling for oil under its said tidelands; and

WHEREAS, the said D. W. Elliott has agreed that he will
deposit with the City of Newport Beach the sum of $1500.00 to
cover any and all expenses which said city may be put to in
connection with the proposed agreement with him.
NOY19 THEREFORE, BE IT RESOLVED that the City Council of
the city of Newport Beach will immediately order work to be
commenced in the preparation of necessary agreements and other
instruments in writing, in reference to the development of said
city's tidelands by subterranean drilling by said D. W. Elliott,
and will present to said D. W. Elliott within sixty (60) days
from date hereof, an agreement covering the drilling for oil under
said city's tidelands, by said D. W. Elliott.
BE IT FURTHER RESOLVED that the said sum of 01500.00 is
the maximum cost to the city for the work to be done in connection
with the agreement mentioned in this resolution, and that if there
is any money left over from the fund so deposited when all work
in connection with said agreement shall have been completed, that
said overage shall be paid to D. W. Elliott in the manner required
by the ordinances of the city of Newport Beach.
BE IT FURTHER RESOLVED that if for any reason an agreement
shall not be made or entered into between said city and the said
D. W. Elliott, in reference to the development of said tidelands,
within the time stipulated, the said D. W. Elliott shall neverthe-
less be responsible and liable for the costs and expenses that the
city may be put to in reference to the matters herein stated,
not to exceed, however, the sum of $1500,00 aforesaid.
I hereby certify that the above and foregoing
resolution was duly and regularly passed and adopted by the
City Council of the city of Newport Beach at an adjournedregular
