HomeMy WebLinkAbout2816 - Annexation of Harbor Island• s 1 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION NO. it's s 1 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH CALLING AN ELECTION TO BE HELD IN THE UNINCORPORATED TERRITORY KNOWN AS "HARBOR ISLAND", FOR THE PURPOSE OF SUB - MITTING TO THE QUALIFIED ELECTORS THEREOF THE QUESTION, WHETHER SUCH TERRITORY SHALL BE ANNEXED TO, INCORPORATED IN AND L1ADE A PART OF THE CITY OF NEWPORT BEACH; APPOINTING ELECTION OFFICERS AND DESIGNATING A POLLING PLACE FOR SAID ELECTION TO BE HELD IN TPI UNINCORPORATED TERRITORY KNOWN AS "HARBOR ISLAND ", ON WEDNESDAY, THE 29TH DAY OF SEPTEMBER, 1943, AND PROVIDING FOR THE OPEN- ING AND CLOSING OF THE POLLS AND THE COMPENSA- TION OF ELECTION OFFICERS. WHEREAS, the City Council of the City of Newport Beach has heretofore adopted a resolution of intention to call a special election in that certain unincorporated territory located in the County of Orange, State of California, and more particularly described as follows, to -wit: Beginning at a point in the boundary line of the Oi�y of Newport Beach, California, which point is South 29 001 West, 350.00 feet from U. S. Bulkhead Station No. 130, as said Station is laid out and shown upon a Map of Newport Bay, California, Showing Harbor Lines, approved by the War Department January 18th, 1917; running thence South 610 001 East along the existing city boundary line 1559.02 feet to an angle point in the said boundary line; thence southeasterly along said boundary line in a direct line to a point in the westerly line of Section 35, Township 6 South, Range 10 West, Sap Bernardino Base and Meridian, which point is 1850.00 feet southerly of the northwesterly corner of said Section 35; thence South 510 001 East along said boundary line, a distance of 400 feet to a point; thence North 460 37+ East along said boundary line to U. S. Bulkhead Station No. 150, as shown and laid out upon the aforesaid map of Newport Bay, California, Showing Harbor Lines; thence North 480 371 East along said boundary line, a distance of 172.81 feet to its intersection with a line, which line is 200 feet northerly of and parallel with the bulkhead line extending from U. S. Bulkhead Station No. 151 to U. S. Bulkhead Station No. 152, as said bulkhead line and bulkhead stations are laid out and shown upon the aforesaid Map of Newport Bay, California, Showing Harbor Lines;thence LAW OFFICES OF �I ROLAND THOMPSON - 1 - 210 SPURGEON BLDG. Government Bulkhead Line between Station 100 and Station 101, as laid 3 out and shown upon said Nap of Newport Hay, California, Showing Harbor Lines, which point is the southwesterly 4 corner of the parcel of land as deeded to the City of Newport Beach by deed recorded in Hook 249, page 424, 5 Official Records of Orange County, California; thence. North 390 48, West along the said boundary line, a distance 6 of 351.54 feet to the most westerly corner of said parcel of land deeded to the City of Newport Beach; thence North 7 39° 481 West along the ordinary high tide line of the Pacific Ocean in Newport Hay, as established by decree in 8 Court Case No. 24026 of the Superior Court in and for Orange County, California, a certified copy of which decree was 9 recorded September 19th, 1928, in Hook 199, page 275, Official Records of Orange Oounty, California, a distance 10 of 334.27 feet to an angle point in said ordinary high tide line; thence North 710 54t West a distance of 1010.00 11 feet to a point which bears South 350 28t 18" West, 144.43 feet from U. S. Bulkhead Station No. 135, as said bulkhead 12 station is shown upon a map - entitled "Harbor Lines, Newport Hay Harbor, California ", approved by the War Department 13 May 2nd, 1936; thence South 750 llt 44" West, a distance of 1401.60 feet to the point of beginning. 14 15 for the purpose of submitting to the qualified electors in the 16 above described territory, the question, whether such territory 17 shall be annexed to, incorporated in and made a part of such 18 municipal corporation; that said resolution duly adopted as 19 aforesaid, did specifically describe the boundaries of the 20 territory so proposed to be annexed to the city of Newport Beach, 21 which boundaries are heretofore described, and further said 22I1reeolution designated such territory as "Harbor Island ", which 23 24 25 26 27 28 29 30 31 32 euch territory may be referred to and indicated upon the s to be used at the election hereinafter referred to; and WHEREAS, said Resolution of Intention No, 2798 aforesaid, tained a notice of the day, hour and place when and where person owning real property within such territory above cribed and proposed to be annexed, and having any objections the proposed annexation, might appear before the legislative y and show cause why such territory should not be so annexed. h hearing was duly and regularly set for the 2nd day of August, 3, at the hour of 7:30 o'clock P. Chambers of the City Council of the City of Newport Beach, located in the City Hall in said city; and AREAS, the City Council has found and determined that protests against said proposed annexation have not been made by the owner or owners of a majority of the separate parcels of property within the territory proposed to be annexed and heretofore described, and all other protests were by the City Council duly and regularly over - ruled. NOW, THEIWORE;BE IT RESOLVED by the City Council of the City of Newport Beach, as follows: Section 1. That an election be held, and the same is hereby called to be held in the territory above described, known as "Harbor Island ", on Wednesday, the 29th day of September, 1943, for the purpose of submitting to the qualified electors of said "Harbor Island" the question, whether such "Harbor Island" shall be annexed to, incorporated in and made a part of the city of Newport Beach. Section 2. That the polls for said election shall be open at six o'clock A. M. of the day of said election, and must be and remain open continuously from said time until seven o'clock P. M. of the same day, when said polls will be closed, except and provided, however, that if at said hour of closing there are any voters at the polling place or in line at the entrance thereof, who are qualified to vote and who have not been able to do so since appearing, the polls shall be kept open a sufficient length of time to enable them to vote, but no one who shall arrive at the polling place after seven o1clock P. M. of said day, shall be entitled to vote, although the polls may be open when such person may arrive. CALIF. 5 <` MARK CROSSES (x) ON BALLOT ONLY WITH RUBBER STAMP, NEVER WITH PEN OR PENCIL INSTRUCTIONS TO VOTERS To vote on the proposition hereinafter set forth, stamp a cross (x) in the voting square after the printed word "Yes ", or after the printed word "No". If you shall stamp a cross (x) in the voting square after the printed word "Yes ", said vote shall be counted in favor of the annexation of "Harbor Island" to the City f Newport Beach, and if you shall stamp a cross (x) in the voting square after the printed word "No ", said vote shall be counted against said annexation of "Harbor Island" to the City of Newport Beach. All marks, except the cross (x) are forbidden. All distinguishing marks or erasures are forbidden and make the ballot void. If you wrongly stamp, tear or deface this ballot, return it to the Inspector of Election and obtain another. :PROPOSITION. ; YES :Shall "Harbor Island" be annexed , :to the City of Newport Beach? NO L Section 3. That for the purpose of holding said election, one (1) regular election precinct is hereby established in said territory known as "Harbor Island" and heretofore specifically described, which election precinct is to be known hereafter as Election Precinct No. 1, and the boundaries of said Election Precinct No. 1 shall be the present existing boundary lines of the territory proposed to be annexed to the city of Newport Beach and heretofore described; that the polling place for said Election Precinct No. 1 as aforesaid, so established, shall be at the place hereinafter designated, and the persons hereinafter named, being competent and qualified electors and residents of said territory proposed to be annexed and knopa as "Harbor Island" aforesaid, are hereby appointed officers of election, for said Election Precinct No. 1 as aforesaid, and 4 I - -I- 1 A 31 4 5 a 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 LAW OFFICES OF ROLAND THOMPSON 210 SPURGEON SLOG. The holding and conducting of said election shall be in conformity, as near as may be, with the laws of the State of California concerning general elections, except as herein otherwise provided. Section 5. That the City Council of said city shall meet and canvass the returns of said election at the regular meeting place of said City Council to be held in the City Counoil chambers of the City Council of said city in the City Ball of said city, on Monday, the 4th day of October, 1943, at the hour of four otolook P. M. of said day. Immediately upon the completion of such canvass, the City Council shall oause a record thereof to be made and entered upon its minutes stating the proposition submitted and showing the whole number of votes cast thereon in the territory heretofore described, and known as "Harbor Island", the number of votes oast therein in favor of annexation and the number of votes oast therein against annexation. Section 6. CM1LI F. in the County of Orange, being the County in which the territory heretofore described and known as "Harbor Island" is situated, at least once a week for a period of four (4) successive weeks, neat preceding the 29th day of September, 1943. Section 7. That each of said election officers heretofore designated, be paid the sum of $5.00 as full compensation for their services in conducting said election to be held on Wednesday, the 29th day of September, 1943. I hereby certify that the above and foregoing Resolution was duly and regularly passed and adopted by the City Council of the city of Newport Beach at a regular meeting thereof held on the L— day of 1943, by the following vote, to -wit: AYES, COUNCILMEN: NOES, COUNCILMEN: ABSENT, COUNCILMEN: n TEST: ( L ^ i Mayor
