1 A RESOLUTION OF THE COUNCIL OF THE
CITY OF NEt1PORT BEACH, CALIFORNIA,
2 TERh4INATING THE LIABILITY UNDER
FAITHFUL PERFORMANCE BOND DATED
• 3 DECEMBER 7, 1925, RELATIVE TO FRAN-
CHISE GRANTED BY ORDINANCE NO. 254.

5 WHEREAS, the Council of the City of Newport Beach,
6 California, did by Ordinance No. 254 granted on the 14th day of
7 December, 1925, grant to Southern Counties Gas Company of Cali-
8 fornia, the right, franchise and privilege to maintain and oper-
9 ate a system of gas pipes in, under and along all public streets,
10 highways, and alleys then or hereafter existing within the City
11 of Newport Beach.
12 WHEREAS, Southern Counties Gas Company of California,
13 as principal and Indemnity Insurance Company of North America
14 as surety, filed a bond in the penal sum of Five Hundred Dollars
15 ($500.00) dated December 7, 1925 to comply with the terms and
16 conditions of said franchise.
17 NOW, THEREFORE, be it resolved by the City Council of
18 the City of Newport Beach, California:
19 SECTION 1. That all liability and responsibility of
20 Southern Counties Gas Company of California as principal and
21 Indemnity Insurance Company of North America as surety under the
22 aforesaid bond be terminated and they are hereby discharged and
23 released from all obligations under said bond from and after this
24 date.
25 SECTION 2, The City Clerk shall certify to the adoption
26 of this Resolution and thenceforth and thereafter same shall be
27 in full force and effect.
28 Adopted and approved this _day of September,
29 1943.
