RESOLUTION NO.
WEEREAS, the City Attorney of the City of Newport
Beach has this day presented for the consideration of the City
Council of said city of Newport Beach a certain agreement in
writing between the city of Newport Beach and one D. 17. Elliott;
and
WHEREAS, by the terms of said agreement, D. W. Elliott
is employed and engaged by the city of Newport Beach as an in-
it
dependent contractor for the term of said agreement, to furnish,
maintain and prepare the necessary drill sites outside of and
beyond the city limits of the city of Newport Beach, and erect
thereon the necessary foundations and derricks for, and to drill
and explore for oil, gas and other hydro - carbon substances, by
the Rotary method, or such other efficient and suitable method
as may be approved by the City, and, in the event oil, gas or
other hydro- carbon substances are found in commercial quantities,
to complete, operate, maintain, redrill, repair, recondition and
deepen as many wells as can economically be bottomed from the
drill cites obtained, until there has been completed and brought
to production one well bottomed in each ten acres in those
certain tidelands which the City of Newport Beach claims owner-
ship in and over, and located in said city and more particularly
described as follows, to -wit:
All those certain uplands, tidelands, submerged
lands and filled lands owned by the City of
Newport Beach, lying between the southwesterly
prolongation of the southeasterly line of 53rd
Street, as said 53rd Street is laid out and shown
upon a map of Ocean Front Tract, Newport Beach,
recorded in Book 4, page 12 of Miscellaneous Maps,
records of Orange County, California, and the
westerly boundary line of the city of Newport
Beach, and southwesterly of the northeasterly line
of Ocean Front, formerly Ocean Avenue, as said
Ocean Avenue is laid out and shown upon said map
of Ocean Front, and map of Seashore Colony Tract,
recorded in Book 7, page 25 of Miscellaneous Maps,
Records of said County.

And WHEREAS, all the work to be done under the terms
of said contract by the said D. W. Elliott shall be under the
terms of said agreement aforesaid, done and performed by him at
his sole cost and expense and for the consideration in said
contract set forth; and
WHEREAS, the City Oounoil of the city of Newport
Beach believes that it is for the best interests of the city
of Newport Beach and the inhabitants thereof that said contract
be executed as written; and
WHEREAS, it is further the opinion and judgment
of the City Council of the city of Newport Beach that the
consideration for the making of said contract is in all
respects fair and just and that the said D. W. Elliott is
financially able to carry out the terms, oovenants and
conditions of said agreement in accordance with its true intent
and purpose, and in accordance with the terms, conditions and
oovenants thereof.
NOW, THEREFORE, BE IT RESOLVED that the City Oounoil
of the city of Newport Beach believes that it is for the best
interests and welfare of the City of Newport Beach and the
inhabitants thereof that said contract be executed by the
City of Newport Beach,
BE IT FURTHER RESOLVED that the said D. W. Elliott
is in the opinion and judgment of the City Oounoil of the .
City of Newport Beach, financailly able to oarry out the terms,
conditions and oovenants of said contract in accordance with
the terms, conditions and oovenants thereof, and in accordance
with the true intent and meaning thereof, and that the said
D. W. Elliott is in all respects a responsible person, experienced
in the development of oil, gas and other hydro - oarbon substances
in the State of California.

BE IT FURTHER RESOLVED that the Mayor and City Clerk
of the City of Newport Beach be, and they are hereby directed,
authorized and instructed to execute said contract in the name
of, and on behalf of the city of Newport Beach, and that the
City Clerk deliver a duly executed copy thereof to D. W. Elliott,
Contractor therein named.
I hereby certify that the above and foregoing
resolution was duly and regularly passed and adopted by the
City Council of the city of Newport Beach at a regular meeting
thereof held on the W$ day of V- ""`' 1943,
by the following vote, to -wit:
