HomeMy WebLinkAbout3877 - Street Lighting System1 2 • 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ' 29 30 31 32 C 0 P Y RESOLUTION NO. 3877 RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH, CALIFORNIA, ADOPTED PURSUANT TO THE REQUIREMENTS OF THE SPECIAL ASSESSMENT INVESTIGATION, LIMITATION AND MAJORITY PROTEST ACT OF 1931 "2 BEING PART 2, DIVISION IV OF THE STREETS AND HIGWAYS CODE OF THE STATE OF CALIFORNIA TIHEREAS, the City Council of the City of Newport Beach, California, having heretofore instructed the City Engineer in the matter of the proposed street lighting system in certain easements over, along and across Lots A, B and C of Tract No. 1011 to procure the data and prepare a written report pursuant to the provisions of the "Special Assessment Investigation, Limitation and Majority Protest Act of 1931 ", being Part 2, Division IV of the Streets and Highways Code of the State of California, and thereafter the said City Engineer presented to this City Council the said written report;and VTHEREAS, pursuant to the provisions of said Party Division IV of the said Streets and Highways Code, the City Council shall be resolution or ordinance determine in general the nature, location and extent of the proposed improvement; generally define the boundaries or extent of the district or lands to be specially assessed to pay the costs thereof, or any part of such costs; and determine the statute under which it is pro- posed to conduct the proceedings for such improvement and for the issuance of bonds therein, if any. NOW, THEREFORE, BE IT RESOLVED AND DETERMINED by the City Council of the City of Newport Beach, California, as follows: 1. That the written report presented by the City Engineer for the proposed improvement herein referred to is hereby and it is ordered that the said report be filed in the office of the City Clerk for public inspection. 2. That the proposed improvement herein mentioned is described as: Fl 1 2 • 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ' 29 30 31 32 (a) The construction and installation of a street lighting system, consisting of cement concrete posts or standards (Marbelite Design No, 43 -D4), each equipped with one luminaire, including 2500 lumen incandescent lamp, using 5000 volt Thermoplastic Cable installed in galvanized iron pipe conduit, and appurtenant work in connection therewith; in that certain public EASEMENT owned by the City of Newport Beach, over, along and across Lots A, B and C of Tract No, 1011, as per map recorded in Miscellaneous Map Book 36, Pages 37 to 40 inclusive, Records of Orange County, California, (b) The construction and installation of a 5000 volt Thermoplastic Cable installed in galvanized iron pipe conduit, and appurtenant work in connection therewith; in the Southerly side of STATE HIGWAY adjacent to said Lots A and B of said Tract No, 1011, 2> That all of the said work and improvement proposed to be done shall be constructed along the lines, bet *. -een the points and at the places shown on Map 435, consisting of one sheet, filed with this report and by this reference made a part hereof. 3. That the district or lands to be specially assessed to pay the costs and expenses of said proposed lighting system is shown upon the map, consisting of one (1) sheet, filed with and forming a part of said written report. Reference is hereby made to said map for a further, full and more complete description of said assessment district, and the said map so on file with report shall govern for all details as to the extent of said assessment district. 1 2 • 3 • 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 ' 29 30 31 32 4. That the proposed improvement shall be done under the provisions of the "Improvement Act of 1911 ", being Division 7 of the Streets and Highways Code of the State of California. 5. That it is hereby determined that serial bonds, to represent unpaid assessments and bearing interest at the rate of six per cent (6 %) per annum, shall be issued to represent each assessment of THrenty -five Dollars ($25.00) or more remaining unpaid for thirty (30) days after the date of recording the warrant. Said serial bonds shall extend over a period ending nine (9) years from the second day of January next succeeding the next October 15th following their date, the said bonds to be issued under the provisions of the said "Improvement Act of 1911 ", being Part 5 of Division VII of said Streets and Highways Code. 6, That the said City Council hereby fixes Monday, the 25th day of June, 1951, at the hour of eight o'clock (8:00) P.M., as the day and hour and the chambers of the City Council in the City Hall of said City as the place of hearing on the written report of the City Engineer, and hereby orders such hearing to be held by the City Council of said City.
