HomeMy WebLinkAbout3891 - Alley Vacation & Abandonment - Tract 9481 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 RESOLUTION its. 3"/ RESOLUTION ORDERINq VACATION NKMAS, the City of Newport Beach did, on the 14th der of May, 1951, pass its certain Resolution of Intention NO.�a declaring its intention to order the closing up, vQOation and abandonment of a portion of an alley in Tract No. 948 1n the City of Newport,Beaoh, hereinafter more partioularly described, pursuant to and in accordance with the "Street Vacation Act of 1941" and all amendments thereto, being Sections 5300 through 6331 of the California Streets and highways Code; and WHEREAS, the Strdet Superintendent of the City of New- port Beach has caused to be posted conspicuously along the por- tion of said alley proposed to be vacated, not more than 300 feet apart, and not lose than 3 in all, notices of the vacation of said portion of said alley, all of which will more fully ap- pear from the affidavit of L. W. Covert, the said Street Super. Intendant of the City Of Newport Beach, on file in these pro- ceedings; and WHEREAS said notices so posted by the Street Superin- teM at of the City of Newport Beach stated the preparation of said Reeolution of Intention No. -5r?/ aforesaid, and the date and place of the hearing of all persons interested In or Object- ing to the proposed vacation of said portion of said alloy; and WIMREAS, the City Council of the City of Newport Beaob by said Resolution of Intention No. ?8Al! , aforesaid, did fix Monday, the 11th dear of June, 1951, at the hour of 7:30 p,#. of said day as the time, and the Council Chambers of the City Coos. Oil of the City of Newport Beach, located in the City Hall of the City of Newport Beach, as the place, for the hearing of all persons interested in or objecting to the proposed vacation of said portion of said alley; and WHEREAS, said Resolution of Intention No. 38d'( , afore- I 2 • 3 4 5 e e1 7�8 9 10 11 12 {I{ 13 14 15 18 17 18 19 20 21 22 23 24 25 28 27 28 29 30 31 32 said, has been published at least once in the Newport- Balboa a newspaper of general circulation, printed, :ulalished and circu- lated in the City of Newport Beach, and said Nnblication was made more than 15 days prior to the d._ -.te set for the hearint of all persons interested in or objecting to the proposwd vacation, all of which will more fully appear by the affidavit of Ben Reddiek, owner and publisher of said Mewport- :'altos Frees, on file in these proceedings; and WHZRrAS, the City Council of the City of Newport Beach has heard the evidence, both written anc verbUl, of all perw<ons interested is the vacation of said portion of s.-id alley in this Resolution core particularly hereinafter described, and finds front all the evidence submitted that said portion of said alley described in said Resolution of Intentio.:, and hereinafter des- cribed, is unnecessary for present or prospective public street or alley purposes; NWs T4ZREFci; o the City Council of the City of Newport ach finds and determines sad. hereby orders that the follow ng de ribed portion of that certain alley In the City or Newport Beach, scribed as follows: A portion of that alley sa ub own upon a map of Tract 948, recorded in Miscellaneous yaps, 130ok 30) raEes 6 & 7, Re- cords of Orange County, State of California, and rare par - tioularly described as follows: Beginning at the most southerly corner of i.:ot 15 of said Tract No. 9493 thence northwesterly along the southwester- ly line of said Lot 1 to the most westerly line of said Lot 15; thence southerly along; the southerly prolongation of said most westerly line to ita intersection with the northwesterly prolongation of thy: most southerly line of Lot 16 of said Tract ado. 9�8; thence southeasterly along said northwesterly prolongation to a corner of said Lot 16, which corner is 6191 feet northwesterly from the most southerly corner of said Lot 16; thence northwesterly alon the southwesterly line of said Lot 16, to the point of beg Is unnecessary for present or pro pective public street or alley purposes, and now makes itz order — Waling P-Ad portion of said alley above described. The above and foregoing ?lesolution No. was duly passed and adopted at a regular meeting of the City Council of the City of Newport 'Beach, held on the 11th day of June, 1951, by the following vote to wit.
