RESOLUTION NO. 4572
WHEREAS, pursuant to instructions, theCity Attorney of
the City of Newport Beach has prepared a contract in which the
City of Newport Beach agrees to sell certain excess water of said
City to the HELIPOT CORPORATION, a corporation, upon the condit
covenants and restrictions in said contract set forth; and
WHEREAS, said contract has been duly presented by the
City Attorney to the City Council of the City of Newport Beach,
for its acceptance and approval.
NOW, THEREFORE, BE IT RESOLVED, that that certain con-
tract made and entered into the 26th day of November, 1956, by and
between the City of Newport Beach and the Helipot Corporation, a
corporation, wherein and whereby the City of Newport Beach agrees
to sell certain of its excess water upon certain conditions,
restrictions and limitations to said Helipot Corporation, be and
the same is hereby approved as written.
AND BE IT FURTHER RESOLVED, that the Mayor and the City
Clerk be, and they are hereby authorized and directed to execute
said contract in the name of and for and on behalf of the City
of Newport Beach.
The above and foregoing resolution was duly and
passed and adopted by the City Council of the City of Newport Beac
at a regular meeting thereof held on the 26th day of November,
by the following roll call vote, to wit:

between Industrial Way and Placentia Avenue in the County of
0rMV, State of Califoraia, said proportionate cost being of
the approximate saes of $10500.00.
4. That iieiipot agrees to pay for said water consumed
the am of 12; per 100 cu. ft. as measured and determined by
a meter to be placed in the vicinity of Beslipot's proposed
building, payments to be made bi- monthly and at the time and is
the masker provided by city ordinance and the rules and regula-
tions of the water Department of said City.
5. That said Relipot will at all times comply with all
rules and regulatims of the Water Department of the city of
Seaport Reach and such further rules and regulations as the
Water Department of the City of Seaport Beach may prescribe from
time to time during the term hereof, and agrees to pay for all
water used by it at the time and in the manner prescribed by
the rules and regulations of the water Bepertmsnt of the city of
Newport Beach,
6. That the excess water sold hereunder is sold only
from month to ianth during the existence of such excess and is
sold in accordance with ordinances #292 and #352 of the City of
Newport Beach and that the City Council may declare at any time
during the existence of this contract that said City of Newport
Reach has not sufficient excess water to sell and may thereupon
tesmInste this contract by giving 10 days' written notice to
that effect to Helipot.
7. That none of the provisions of this contract shall
mom or be construed to paean that city shall be required to sell
its excess 'water or that the excess water once furnished to
Relipot shall continue to be furnished and that the water so
agreed to be furnished shall be furnished only during such times
as the City Council of the City of import Reach may, in its
Judgment,, believe that the furnishing, of said water will not
