of the City of Newport Beach A certain agreement between the
City of Newport loch and the Cormunity Youth Center of Newport

WAS, the City Council determines. that the terms
and conditions of said agreement +are satiefaotory, and
WHSR B, said agreement would be for the best interests
of the citizens of Newport Beach, particularly the young people
thereof j
NOW, THMWORE, HE IT AWOLVED by the City Council of
the City of Newport Beach that the Mayor and City Clerk be, and
they are hereby, authorized and directed to execute said agremont
for and on behalf of said city.
The above and foregoing resolution No. ,L1,U�
was duly and regularly passed area adopted by the City Council
of the City of Newport Beach at a regular meeting thereof, held
on the day of June, 1956, by the following roll call
vote, to wit:

THIS AGREffi1ENT* made and entered into this
of �`� , 1956, by and between the City of
Newport Beach, a municipal corporation, hereinafter referred to
11as "City" and Community Youth Center of Newport Harbor, a non-
profit corporation, hereinafter referred to as C.Y.C.
WITNEBSET:i:
WHEJWAS, X340 is presently the owner of a license
granted by the .Newport Beach Elementary School District to use
a portion of Block 93, Irvine Subdivision, as shoem on a map
recorded in Book 1, Page 88 of Miscellaneous Maps, records of
Orange County, California, being that portion of Harbor View
School site lying southeasterly of the existing fence, for a
youth center; and
WHEREAS, C.Y.C. has erected on said property a building
Ito be used for a youth center for the citdzens of the City of
Newport Beach; and
WHEREAS, City is desirous of using said building and is
willing to supervise recreational and educational programs
oonduated on the aforesaid real property;
NOW, TAERWORE, in consideration of their mutual
promises, the parties hereto agree as folloxs:
1. That C.Y.C. grants to City the right to use the
building and grounds as hereinabove described, said building
and grounds to be used exblusively for reoreational, educational
and other non- profit uses, for all of the citizens of the City
of Newport Beach and particularly the young people of said
community.
2. That said City will provide supervision for programs
and activities sponsored by City.
3. That City shall have the exclusive control of the

scheduling of all programs and activities to be conducted on
said property for the aforesaid uses.
4. That City will be responsible only for injuries
and damages arising out of program and activities sponsored
and supervised by City's recreation department and City will
carry liability insurance to cover such programs and activities.
5.-8t C.Y.C. will be responsible for the payment
of all bills pertaining to the comoetion of the building,
and for the gas and electricity bills.
6. That a representative of the Recreation Department
of the City of Newport Beach shell attend the meetings of
the Board of Directors of C.Y.C. for the purpose of making
reports upon the use of the property and the program of
activities conducted upon the premises. The Board of Directors
of C,Y.C. shall continue to serve as an advisory grog for
the promotion of the use of the property.
7. That upon termination of this Agreement, City
will have the right to remove all of its equiat and
fixtures which have been installed by City, which in the
removal thereof will not materially damage the building.
S. This agreement will be for a terra of two yea's,
commencing on the // day of 1956, and
ending on the =day of 195.
9. Either party shall have the right to terminate
this agreement at any time by giving the other party 60 days
written notice of its intention to terminate.
10. It is further understood that C.Y.G. owns only a
license to use said land for youth center purposes and that
such license may be terminated by the Newport Beach Elementary
School District giving to C.Y.G. a written 90-day notice to
vacate. In the event such notice is given to C.Y.C., the
C.Y.C. shall immediately notify the City of Newport Beach them

and the City of Newport Beach shall remove all improvements
which it has placed upon the property.
11. This ageement shall become effective only upon its
approval by the Board of Trustees of the Newport Beach
Elementary School District.
