RESOLUTION NO. 4511
RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT. BEACH, CALIFORNIA, DESCRIBING CERTAIN
PROPOSED CHANGES AND MODIFICATIONS IN THE WORK
UNDER RESOLUTION OF' INTENTION NO. 44219 DECLARING
ITS INTENTION TO PROPOSE SAID CHANGES AND
MODIFICATIONS AND FIXING A TIME AND PLACE FOP.
HEARING OBJECTIONS TO SAID PROPOSED CHANGES,
AND GIVING NOTICE THEREOF.
WHEREAS, this City Council did on the 27th day of
December, 1955, adopt its Resolution of Intention No. 4421
declaring its intention to order certain work and improvement
in 31st Street and other streets and rights of way in said
City and after notice duly given, did hold a hearing thereon
at the time and place fixed in said Resolution of Intention,
at which hearing protests or objections were not made by the
owners of more than one -half of the area to be assessed for said
improvement; and,
WHEREAS, this Council did thereupon acquire jurisdiction
and did, by Resolution, order the work described in said
Resolution of Intention No. 4421, and 'after notice duly given
received bids for and entered into a contract for the doing of
said work; and,
WHEREAS, it now appears that certain changes and modifi-
cations should be made in the work in 47th Street as described in
said Resolution of Intention No. 4421; that said proposed changes
and modifications are shown upon that certain plan known as Sheet
6A of Plan No. 440 showing the plan of the proposed revision of
grade and curb on the northwest side of 47th Street and has been
approved by this Council. and ordered filed in the Office of the
City Engineer.
NOW THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
BEA6H, CALIFORNIA DOES HEREBY RESOLVE, DETERMINE
AND ORDER AS FOLLM :
SECTION 1. That the public interest and convenience
require and it is the intention of the City Council of said City
to order certain changes, modifications, and revisions in the

work on 47th Street, in the following manner, to wit: The changii
and modifying of the grade for the said work on 47th Street and
in the curb along the northwest side of said 47th Street between
Neptune Avenue and Balboa Blvd. and in the intersections thereof,
eliminating certain gutter on the said northwest side of 47th
Street, all in the manner and extent as shown on said Sheet 6A
of said Plan No. 440, which said plan is hereby referred to for tl
said changes, modifications and revisions, which said plan,
including the profiles thereon shown, are incorporated herein and
made a part of this Resolution and shall govern for all details
as to the extent, manner, and location of the proposed changes
and modifications herein proposed to be ordered.
SECTION 2. That it is estimated that the cost of doing the
work as originally contemplated will be increased, by reason of
the changes proposed to be made as set forth herein, by the sum
of $284.00.
SECTION 3. It is further the intention of the Council to
change the provision made in Resolution No. 4440 providing that
the assessment in the proceedings be made and signed by the City
Engineer by eliminating Section 2 of said Resolution No. 4440.
SECTION 4. That notice is hereby given that the 23 day of
July, 1956, at the hour of 7:30 p.m., in the Council Chambers of
this City Council in the City Hall in the City of Newport Beach,
California, is the time and place when and were any and all
persons having any objections to the changes proposed to be made
may appear before the City Council and show cause why said chang
should not be ordered, in accordance with this Resolution.
Objections must be in writing and be filed with the City Clerk
of said City not later than the time set for hearing of said
objections.
SECTION 5. The City Clerk of said City is hereby directed
to certify to the adoption of this Resolution and to cause the

same to be published once not less than ten (10) days prior to
the date of said hearing in Newport Harbor Ensign, a newspaper
published; and circulated in said City, which newspaper is here-
by designated by the Council for the publication of this
Resolution.
APPROVED and ADOPTED by the City Council, signed by the
Mayor, and attested by the City Clerk, this 9th day of July,
1956.
