WW1-FA-S5# the City of Newport Beach on the 23rd day of
July, 19569 passed its certain Resolution of intention No. 4524,
declaring its intention to order the closing up, vacation and
abandonment of a portion of certain streets and alleys in
Section B Newport Beach, in the City of Newport Beach, and
hereinafter more particularly describead, pursuant to and in
accordance with the "Street Vacation Act of 1941", approved
Kay 13t 19411 Statutes 1941, Chapter 250 and amendments thereto,
being Division 95 Part 39 Chapters 2 and 3, Sections 8320 to
8331, inclusive, Streets and Highways Code; and
td}EREAS, the Street Superintendent of the City of
Newport Beach has caused to be conspicuously posted along
the line of the portion of the streets and alleys proposed to
be vacated, not more than 300 feet apart, but not less than
three in all, notices of the vacation of said portion of said
streets and alleys, all of which will more fully appear from
the affidavit of L. '.io Covert, the Street Superintendent of
said City of Newport Mach, on file in these proceedings; and
WHRR8'AS, said notices so posted by the street Super-
intendant of the City of Newport Bleach, stated the passage of
said Resolution of Intention Woo 4524, aforesaid, and the date
and place of the hearing of all persons interested in or
objecting to the proposed vacation of said part of said streets
and alleys; and
WEIMEAB, the City Council of the City of Newport Beach
by said Resolution of Intention aforesaid, did fix Monday, the
13th day of August, 19561, at the hour of 7 :30 F.149 of said day

Newport Beach, located in the City Hall of the City of Newport
Beach, as the time and place for the hearing of all persons

interested in or objecting to the proposed vacation of said
part of said streets and alleys; and
WfiWWASI said Resolution of Intention No. 4524,
aforesaid, has been published at least once in the MPORT
HARBM ENSIGNO a newspaper of general circulation printed,
published and circulated in the City of Newport Beach, and
said publication was made more than fifteen days before the
date set for the hearing of all persons interested in or object -
ing to the proposed vacation, all of which will more fully
appear by the affidavit of Arvo S. Haapa, osner and publisher
of said Newport Harbor Ensignq on file in these proceedings;
and
WHEREAS, the City Council has hoard the evidence, both
written and verbal, by all personas interested in the vacation of
said part of said streets and alleys in this Resolution more
particularly hereinafter described, and finds from all the
evidence submitted that said part of said streets and alleys
described in said Resolution of Intention, and hereinafter
described, are unnecessary for present or prospective street
purposes;
NOWl THERIVORE, the City Council of the City of Newport
Beach finds and determines and hereby orders; that the following
described part of certain streets and alleys in the City of
Newport Beach, described as follows:
All of those portions of 16th Street and 17th
Street and a portion of that certain alley 20
feet In width, as shown upon a map of Section B
ach, recorded in Riiscellansous Baps
, Page 27, Records of Orange Countyy E74
rnia, and more particularly described as
follows
Be at the northwesterly corner of Block
11 as shown upon said map of Section B Newport
Beach thence easterly along the northerly line
of said Block 117 to the northeast corner thereof;
thence southerly along the easterly line of said
Block 117 to the southeast corner thereof; thence
In a straight line to the southwest corner of

20 feet in width to a point of intersection
with the northerly prolongation of the westerly
line of the aforementioned Block 117; thence
southerly along said northerly prolongation to
the point of beginning,
is unnecessary for present or prospective public street purposes►
and now makes its order vacating said part of said streets and
alleys described► subject to they reservations and exceptions
hereinafter reserved by the City of Newport Beach
The City Council further finds and determines► and
It is hereby ordered' that the public easement in the part of
said streets and alleys heretofore described has► upon the
passage of this Resolutlon' ceased except that the City
reserves and excepts from said vacation the permanent easement
and right' at any time' or from time to time► to construct►
maintain► operate► replace► remove and renew sanitary sewers
and storm drains and appurtenant structures in► upon► over
and alleys
and across said part of said streets/so proposed to be vacated
and pursuant to any existing franchises or renewals thereof►
or otherwise, to construct► maintain, operate► replace► remove►
renew and enlarge lines of pipet conduits► cables► wires, poles►
and other convenient structuresp equipment and fixtures for

the operation of gas pipe linest telegraphic and telephone
lines, railroad lines, and for the transportation or dis.
tribution of electric energy, petroleum and its productsq
ammonia* waters and incidental purposes, including access
and the right to keep the property free from inflammable
materials) and wood growths and otherwise protect the same
from all hazards ins upon and over said part of said streets
and alleys.
The City Council further orders that the City Clark
of the City of Newport Beach shall cause a certified copy of
this order, duly attested by her as the City Clerkt under the
seal of the Cityt to be recorded in the office of the County
Recorder of orange County, State of California, immediately
following the passage of this Resolution..
The above and foregoing resolution No, 41re;L- was
passed at a regular meeting of the City Council of the City
of Newport Beach, held on the 13 tk day of
