2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF AN
• 3 AGREEMENT BETWEEN JOHN F. VOGEL and ERMON W.
SMITH AND THE CITY OF NEWPORT BEACH FOR THE
4 CONSTRUCTION OF IMPROVEMENTS.REQUIRED IN RE-
SUBDIVISION NO. 84

6 WHEREAS, there has been presented to the City Council of
7 the City of Newport Beach an agreement wherein John F. Vogel and
8 Ermon W. Smith, applicants on resubdivision No. 84, agree to
9 construct a manhole and sewer with appurtenances and to replace
101 and resurface any pavement removed in connection therewith in an
11 adjoining alley; and
121 WHEREAS, said agreement provides that John F. Vogel and
13 Ermon W. Smith shall file with the City of Newport Beach a surety
14 bond to assure faithful performance of said agreement;
15 NOW, THEREFORE, BE IT RESOLVED that said agreement
16 between John F. Vogel and Ermon W. Smith and the City of Newport
17 Beach in which John F. Vogel and Ermon W. Smith agree to construct
18 the improvements in resubdivision No. 84 be approved and the Mayor
19 and City Clerk are hereby authorized and directed to execute the
20 same on behalf of the City of Newport Beach at such time as John F
21 l Vogel and Ermon W. Smith file with the City said surety bond and
22 said bond is approved by the City Manager as to sufficiency and
231 City Attorney as to form.
24 1 This resolution was adopted by the City Council of the
25 City of Newport Beach at a regular meeting on the gg!7� day of
26 June; -1959, by the following vote, to wit:.
