A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEbdPORT BEACH AUTHORIZING THE EXEECUTION.:OF AN
AGREEMENT BETWEEN J. HERBERT BROWNELL AND PHOEBE
LU BP.OWNELL AND THE CITY.OF NEWPORT BEACH FOR THE
CONSTRUCTION OF IMPROVEMENTS REQUIRED IN RESUB-
DIVISION NO. 82 .
WHEREAS, there has been presented to the City Council of
the City of Newport Beach an agreement wherein J. Herbert Brownell
and Phoebe Lu Brownell, applicants on resubdivision No. 82, agree
to construct street and other public improvements within and such
as are necessary to serve said resubdivision, to wit: improve
alley and put in a wall and other improvements deemed necessary by
the City Engineer; and
WHEREAS, said agreement provides that J. Herbert
and Phoebe Lu Brownell shall file with the City of Newport Beach a
surety bond to assure faithful performance of said agreement;
NOW; THEREFORE, BE IT RESOLVED that said agreement
between J. Herbert Brownell and Phoebe Lu Brownell and the City
of Newport Beach in which J. Herbert Brownell and Phoebe Lu Brown-
ell agree to construct the improvements in resubdivision No. 82
be approved and the Mayor and City Clerk are hereby authorized
and directed to execute the same on behalf of the City of Newport
Beach at such time as J. Herbert Brownell and Phoebe Lu Brownell
file with the City said surety bond and said bond is approved by
the City Manager as to sufficiency and the City Attorney as to
form.
This resolution was adopted by the City Council of the
City of Newport Beach at a regular meeting on the � day of

I, MARGERY SCHROUDER, City Clerk of the City of Newport
Beach, California, do hereby certify that according to the records
of the City of Newport Beach filed and waintained in my office,
the foregoing Resolution No. 5062 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 27th day of duly , 1959, by the following
vote, to wit:
AYES, COUNCILMEN: Kingsley, Atkinson, Hart, Lorenz, Somers
NOES, COUNCILMEN: None
ABSENT, COUNCILMEN: Stoddard, Higbie
