HomeMy WebLinkAbout5067 - Prohibiting Parking on PCHv - y (12) 1 RESOLUTION N0. .S-� 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF NEWPORT BEACH PROHIBITING PARKING ON A. • 3 PORTION OF PACIFIC COAST HIGHWAY 4 5 WHEREAS, Section 3272 of the Newport Beach Municipal 6 Code provides that the city traffic engineer shall sign or mark 7 any place where he determines it is necessary to prohibit parking 8 in order to eliminate an unusual traffic hazard, and when so signed 9 or marked no person shall park a vehicle at any such place; and 10 WHEREAS, Section 589.5 of the Vehicle Code provides that 11 local authorities may by resolution prohibit the parking of vehicle; 121 on a state highway if such resolution is first submitted to and 13 approved by the Department of Public Works; and 14 WHEREAS, the District Engineer of the Division of High - 15 ways has suggested that the Council consider prohibiting parking 16 along the north side of Pacific Coast Highway from the Newport Bay 17 Bridge westerly to a point 315 feet west of the centerline of 18 Dover Drive; and 19 WHEREAS, the city traffic engineer has recommended this 20 prohibition in order to eliminate an unusual traffic hazard; 21 NOW, THEREFORE, BE IT RESOLVED that parking be prohibited 22 along the north side of Pacific Coast Highway from the Newport Bay 23 Bridge westerly to a point 315 feet west of the centerline of Dover 24 Drive. 25 BE IT FURTHER RESOLVED that the traffic engineer be 26 authorized and directed to sign and mark said area indicating that 27 parking is prohibited as provided in Section 3272 of the Newport 0 28I� Beach Municipal Code. _ 29 Any provision of this resolution which regulates traffic 30 or delegates the regulation of traffic upon state highways in any 31 way for which the approval of the Department of Public Works is 32 required by state law, shall cease to be operative six months after 1 receipt by the City Council of written notice of withdrawal of • 2 approval of the Department of Public Works. • 3 Whenever this resolution delegates authority to a city 4 officer, or authorizes action by the City Council to regulate 5 traffic upon a state highway in any way which by state law 6 requires the prior approval of the Department of Public Works, no 7 such officer shall exercise such authority nor shall such action 8 by the City Council be effective with respect to any state highway 9 without the prior approval in writing of the Department of Public 10 Works when and to the extent required by Division 9 and Division 11 11 of the Vehicle Code. 12 This resolution was adopted by the City Council of the 13 City of Newport Beach at a regular meeting on the 10th day of 14 August, 1959, by the following,vote, to wit: 15 AYES, COUNCILMEN: 16 „-U'4w,.,p t L 17 NOES, COUNCILMEN: I 18 ABSENT COUNCILMEN: - - 19 ATTEST: 20 o... 21 City Mer c /C 22 syor 23 24 25 26 27 • 28 • 29 30 31 32 2. 0 0 Awk STATE OF CALIFORNIA COUNTY OF ORANGE CITY OF NEWPORT BEACH SS I, MARGERY SCHROUDER, City Clerk of the City of Newport Beach, California, do hereby certify that according to the records of the City of Newport Beach filed and maintained in my office, the foregoing Resolution No. 5067 was duly and regularly adopted, passed, and approved by the City Council of the City of Newport Beach, California, at a regular meeting of said City Council held at the regular meeting place thereof, on the 10th day of August 9 19 59 by the following vote, to wit: AYES, COUNCILMEN: Kingsley, Atkinson, Higbee, Stoddard, Hart, Lorenz, Somers NOES, COUNCILMEN: None ABSETIT, COUNCILMEN: None Dated this Ilth day of August 19 59 S City Clerk and Zx -O ficio Clerk of the City Council, City df Newport Beach, State of California.
