RESOLUTION NO. 5076
RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH$ CALIFORNIA$ APPROVING REPORT
UNDER "SPECIAL ASSESSMENT INVESTIGATION$
LIMITATION AMID MAJORITY PROTEST ACT OF 1931%
AND FIXING A DATE OF HEARING THEREON$ IN THE
MATTER OF THE CONSTRUCTION OF CERTAIN IMPROVE-
MENTS IN NEPTUNE AVENUE AND OTHER STREETS
WHEREAS, this Council did on the 27th day of July
1959, by Resolution No. 5065 , order the preparation of a
report under the provisions of Division 4 of the Streets and
Highways Code of the State of California, in the matter of the
construction of certain improvements in Neptune Avenue and
other streets in the City of Newport Beach, California, as shown
on Plan No. 444 on file in the Odfice of the City Clerk of
said Cityt and
WHEREAS, such report has been prepared and submitted to
this Council.
NOW$ THEREFORE, THE CITY COUNCIL OF THE CITY OF NEWPORT
BEACH, CALIFORNIA$, DOES HEREBY RESOLVE AS FOLLOWS:
SECTION 1. That the report so prepared and presented be,
and the same is hereby approved, and the fact and date of this
approval shall be endorsed thereon and the report shall be filed
with the Clerk of the City Council.
SECTION 2. That this Council does hereby fix the 28th day
of September , 1959, at the hour of 7,30 o'clock
M., in the Council Chambers in the City Hall of the City
of Newport Beach, California, as the time and place when a hearing
on said report will be held by this Council. The Clerk of
the Council shall give Notice of such hearing by mailing a copy
of the Notice, postage prepaid, to all persons owning real
property which is proposed to be assessed to pay any part of the
cost of the work whose names and addresses appear on the last
equalized assessment roll available on the date the report was
commenced, at his address as shown on such roll, or as known
to the Clerk, all in the manner and form provided for in said
Division 4.
