PORT1C14S Cr CTE14 ST HITS 4 1:i3G -.W AS .LAWCAST,3R STIMET AND IIAL14W STIC12 5 6 The City Council of the City of Hewport Beach, pursuant 7 to the provisions of the "Street Vacation Act of 1941`x, and all 8 amen&aents thereto, being Sections 5300 to 8331, inclusive, of 9 the Streets and Highways Code of the State of California, does 10 hereby resolve and declare as follOG7s: 11 S2M N 1: The public interest and convenience require 12 the closing up and abandonment of portions of certain streets 13 known as Lancaster Street and vlalnut Street in the City of Newport) 14 Beach., and it is the intention of the City Council of the City of 15 Newport 'Beach to order the following described portions of saic? 16 streets in the City of Newport Beach, County of Grange, State of 17 California, to be vacated, closed up and abandoned, to wit: 18 Those certain portions of Lancaster.Street, 40 beet in width, as shorn upon a map of Tract No. 772, -recorded 19 in Book 23, pages 5 and 6, Kiscellaneoas Neaps, records of Orange County, California, and more particularly 20 described as follows, to wit: 21 Parcel 1 22 Beginning at the most southerly corner of Lot 1, Block 15, as shown upon said map of Tract No. 23 772; thence northwesterly along the southwest- erly line of said Lot to the most westerly 24 _1 corner thereof; thence southwesterly on a straight line to the most northerly corner of 25 Lot 14, ;'Bloc's 2, as shown upon said map of Tract Wo. 772; thence southeasterly along the 26 northeasterly line of said Lot 14 to the most easterly corner thereof; thence northeasterly 27 on a straight line to the point of beginning. • 28 Parcel 2: r -- 29 Beginning at the most southerly cornet: of Lot 26 Block 18, as shown upon said map of Tract Wo. Those certain portions of Walnut Street, 40 feet in width, as shown upon a map of Tract No. 772, recorded in Book 23, pages 5 and 6, I1iscellaneous Maps, records of Crange County, California, and more particularly described as follows, to wit: Parcel ii: Beginning at the most easterly corner of Lot 1, Block 22, as shove upon said map of Tract No. 772; thence southwesterly along the southeasterly line 3. 4. I of said Lot 1, to the most southerly corner thereof; . thence southeasterly on a straight line to the most Lot 11, Block 21, as shown upon 2 westerly corner of said map of Tract No. 772; thence northeasterly 3 along the northwesterly line of said Lot 11 to the 14W most northerly corner thereof; thence northwesterly 4 on a straight line to the point of beginning. 5 Parcel B° 6 Beginning at the most easterly corner of Lot 1, Block 23, as shown upon said map of Tract-No. 772; 7 thence southwesterly along the southeasterly line of said Lot 1, to the most southerly corner thereof; 8 thence southeasterly on a straight line to the most westerly corner of Lot 10, Bloc'., 20, as shown upon 9 said map of Tract No. 772; thence northeasterly along the northwesterly line of said Lot 10, to the 10 most northerly corner thereof; thence northwesterly on a straight line to the point of beginning. 11 Parcel C• 12 Beginning at the most easterly corner of Lot 35, 13 Block 23, as shown upon said map of Tract No. 772; thence southwesterly along the southeasterly line 14 of said Lot 35 to the most southerly corner thereof; thence southeasterly on a straight line to the most 15 westerly corner of Lot 11, Block 20, as shoum upon said map of Tract No. 772; .thence northeasterly 16 along the northwesterly line of said Lot 11 to the most northerly corner thereof; thence northwesterly 17 on a straight line to the point of beginning. 18 All of those portions of said streets to be vacated, 19 closed up and abandoned are more clearly shown on a certain map 20 approved and adopted by the City Council of the City of Newport 21 Beach for said vacation, closing up and abandonment, by resolution 22 dated December 14, 1959, and designated "Resolution No. 6-134 23 which said map is on file in the office of the City filer: of the 24 City of Newport Beach. Reference is hereby made to said nap for 25 further particulars as to the proposed vacation, closing up and 26 abandonment of said portions of said streets, and said map is made 27 a part of this resolution by this reference to the same extent and 28 purpose as if it were incorporated herein in full. 29 SECTION 2: The proceedings for the closing up and aban- 30 donment of the aforesaid portions of said streets shall be had and 31 taken, and the City Council of the City of Newport Beach hereby 32 elects to proceed under the provisions of the "Street Vacation Act 4. 5. I of 1941 ", and all amendments thereto, being Sections 5300 to 00331, 2 inclusive, of the Streets and I3ighways Code of the State of 3 California. 4 SECTION 3: The Street Superintendent of the City o` 5 Newport Beach shall cause to be conspicuously posted along the 6 lines of the portions of said streets proposed to be vacated not 7 more than 300 feet apart, but not less than three in all, notices 8 of the vacation of said portions of said streets. Said notices 9 shall state the passage of this Resolution of Intention and the 10 time and place of the hearing of all persons interested in or 11 objecting to the proposed vacation of said portions of said 12 streets. Said notices shall be so posted at least ten days before 13 the date of said hearing, all as required by law. 14 SZCTION 4: Notice is hereby given that the City Council 15 of the City of Newport Beach does hereby fix Monday, the 11th day 16 of January, 1960, at the hour of 7:30 o�clock P. H. of said day, 17 in the Council Chambers of the City of Newport Beach, located in 18 the City Hall of the City of Newport Beach, as the time and place 19 for hearing all persons interested in or objecting to the proposed 20 vacation of said portions of said streets, and the City Council 21 at said time and place will hear the evidence offered by any persa 22 interested in the vacation of said portions of said streets here - 23 i.nbefore described. 24 SECTION 5: This Resolution of intention shall be pub - 25 lished at least once in the Newport Harbor News Press, a newspaper 26 of general circulation, printed, published and circulated in the 27 City of Newport Beach, and said publication shall be made before • 28 the date set for the hearing of all persons interested in or 1W 29 objecting to the proposed vacation. 30 31 This resolution was adopted by the City Council of the 32 City of Newport Beach at a regular meeting on the 14th day of 5. 0 on M 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 6 December, 1959, by the following vote, to wit: / AMA Comic ILLEN: 11. / I u n t� NOES, CCUNCILIEEW: K-"Ir .� ABSZNT CCUNCMEN: Y� ATM ST: City Clerk.
