2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING .CERTAIN- PROPERTY TO BE
3 SURPLUS, AUTHORIZING.ITS SALE-AND SETTING.OUT
THE PROCEDURE, FOR. ITS. SALE_

5 WHEREAS, the City of Newport Beach has acquired certain
6 real property at 213 Walnut Street, Newport Beach, for use as a
7 public street on which is presently located a single -story wood f'.
8 dwelling; and
9I WHEREAS, the removal of such dwelling is necessary and
10 required for the improvement of said real property as a public street;
11 and
12 WHEREAS, said dwelling is not needed in the City service
13 and it is for the public interest and convenience that said dwell -
14
ing be sold and removed so that said real property may be improved
15
as a public street;

NOW, THEREFORE, BE IT RESOLVED as follows:

1. That said dwelling is not needed in the City service
18
and it is for the public interest and convenience that said dwelling
19
be sold and removed so that said real property may be improved as a
20
public street.

2. That the Purchasing Agent of the City of Newport Beac
22
be and he is hereby authorized to advertise such dwelling for sale
23
in a newspaper of general circulation in the Newport Beach area
24
most likely to give notice to potential buyers and, after the lapse
25
of a reasonable time in which to reach any such buyers, to sell
26
said dwelling at the best available price.

3. That the sale shall require the buyer to remove said
28
dwelling from said real property promptly and at has own cost and
•
29
expense•

4. That no warranty shall be made with respect to the
31
character, quality or fitness for any particular purpose of said
32
dwelling or the interest therein which is sold or offered for sale.

5. That the removal of said dwelling and, if such dwell
ing is to be relocated in the City of Newport Beach, such relocatio
shall be in accordance with the ordinances, rules and regulations s
the City of Newport Beach.
60 That the proceeds of the sale of such dwelling less
the costs of such sale shall be deposited by the Finance Director i
the account created for the acquisition of real property for said
public street, being account No. 26-6217 in the Capital Outlay Fund.
