RESOLUTION NO.
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF A
GRANT DEED
WHEREAS, the Orange County Flood Control District has
filed an action in Superior Court under No. 77399 to acquire a
portion of City -owned property described as;
The Westerly 180.00 feet of the land in the Southeast
quarter of Section 19, Township 6 South, Range 10 West,
in Orange County, California, acquired by the City of
Newport Beach by final decree of condemnation entered
August 20, 1937 in Su erior Court Action No. .34747,
recorded August 20,.1937 in Book 910, page 19, of
Official Records of said County, said land being a
square parcel measuring 660 feet on each side;
EXCEPTING all oil, gas and similar hydrocarbon substances
in or.under said land, as reserved in final judgment of
condemnation entered August 20, 1937 in Superior Court Case
No. 34747 Orange County, in favor of Townsend Land Company,
a corporation, their successors and assigns had in an
action entitled City of Newport Beach, a Municipal corpora-
tion, plaintiff, vs. Townsend Land Company, a corporation,
et al., defendants, a.certified copy thereof being recorded
August 20, 1937 in Book 910, page 19 of Official Records,
which judgment provides said defendant shall have the right
to drill for, extract and remove the same, but without the
right to erect or construct any derrick or other structure
whatsoever on said land;
and
WHEREAS, said district and the City of Newport Beach have
entered into a contract under which the City is to execute and
Is grant deed conveying said Cityowned property to the district in
exchange for an agreed price; and
WHEREAS, it is in the best interest of the City of
BBeach to execute and deliver said deed as agreed;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
(Clerk be and are hereby authorized to execute and deliver said deed
conveying the above described propertyto the Orange County Flood
Control District.

said City Council held at the regular meeting place thereof, on
