RESOLUTION NO. 5292
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF AN
AGREEMENT WITH K. W..KOLL ENTERPRISES, INC.
WHEREAS, resubdivision application No. 96, seeking to
divide into four separate lots a portion of Lot 104 of Tract 300 in
the City of Newport Beach, was approved by the Planning Commission
on condition that the applicants enter into a contract with the
City of Newport Beach agreeing to do certain work in connection
therewith and to post a bond to guarantee performance thereof; and
WHEREAS, such an agreement between the City and K. W.
Enterprises, Inc., has been presented to the City Council and the
City Council has considered the terms and conditions thereof and
found them to be fair and equitable, and the required surety bond
has been filed with the City and approved by the City Attorney as
to form;
NOW, THEREFORE, BE IT RESOLVED by the City Council of the
City of Newport Beach that said agreement be approved and the Mayor
and City Clerk are authorized and directed to execute the same on
behalf of the City of Newport Beach.
ADOPTED this 8th day of August, 1960, on the basis that
there is no fraud involved, that there is no misrepresentation of
facts by either party, and the Mayor and the City Clerk be directed
not to sign the agreement unti

of.the City of Newport Beach filed and maintained in my office,
the foregoing Resolution No, 5292 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 8th day of August 19 60 ,'by the following
vote, to wit:
