1 RESOLUTION NO. 5309
2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ANENDING.RESOLUTION NO..5269.WHICH
3 ESTABLISHED PARKING CONTROL -AND PARKING FEES ON
THE_BALBOA.PARKING LOT

5 WHEREAS, Resolution No. 5269 established parking control
6 and parking fees on the Balboa Parking Lot to be in effect from
7 June 15 to September 15 of each year and at certain other desig-
8 nated times; and
9 WHEREAS, it appears to be more appropriate to delegate
10 to the City Manager the authority to fix the exact dates on which
11 the control and charges should apply within the limitations here -
12 inafter set forth;
13 NOW, THEREFORE, BE IT RESOLVED:
14 1. That Paragraph 1 of Resolution No. 5269 be and is
15 hereby amended to read:
16 "1. Parking control shall be maintained on the
Balboa Parking Lot and a daily parking fee shall be
17 charged for using such lot, as follows:
18 ' (a) The City Manager shall establish the
control and begin charging the fee each year on
19 June 1, or thereafter on the date he determines
that there is a need for parking control on the lot
20 and the demand for parking will justify maintaining
attendants thereon, and shall discontinue the con -
21 trol and fees on the day after Labor Day, or on any
subsequent date during the month of September when
22 he determines that the control is no longer neces-
sary and the demand for parking does not justify
23 maintaining attendants on said lot.
24 (b) Monday through Friday, except on
holidays, the parking fee shall be 25¢ per vehicle.

(c) On Saturdays Sundays, and holidays,
26 the parking fee shall be 751 per vehicle."
27 1 2. Paragraph 3 of Resolution No. 5269 be and is hereby
28 amended to read:
29 "3. The City Manager is hereby authorized and
directed to maintain parking control and charge fees not
30 to exceed the daily fees herein established after the
date the controls and fees have been discontinued and
31 prior to the date they are begun for the following summer
season on days when there are special circumstances which
32 result in a need for parking control on the Balboa lot

1 in order to assure orderly and efficient use of the lot.
2 The City Manager is also authorized to waive
the fees established herein where a special event is
3 being held of a charitable or civic nature and it is
in the interest of the City and the general public that
4 fees not be charged for the use of the parking lot in
connection with said special event."

the foregoing Resolution No. 5309 was duly and
regularly adopted, passed, and approved by the City Council of
the City of Newport Beach, California, at a regular meeting of
said City Council held at the regular meeting place thereof, on
the 12th day of September , 19 60 by the following
