RESOLUTION NO. 5317
A RESOLUTION OF THE CITY COUNCIL OF "THE
CITY OF NEWPORT BEACH CANCELING.A CONTRACT
WHEREAS, the City awarded a contract to Goode &
Inc., for the improvement of Parking Lot B on the Corona del Mar
State and City Beach Park; and
WHEREAS, after beginning work on the ground, it has
become apparent that the location of the lot will encroach upon
the usable beach area and may be subject to inundation or damage
by high waves by reason of its proximity to the present surf line;
and
WHEREAS, the contractor has agreed to cancel the cont
upon being paid only for its actual costs to date; and
WHEREAS, it would be in the interests of the City and
in the public interest to cancel said contract and revise the
plans and change the location of said parking lot;
NOW, THEREFORE, BE IT RESOLVED that the contract with
Goode & Schroeder, Inc., for the improvement of Parking Lot B at
said Corona del Mar State and City Beach Park be canceled and
that the City reimburse said contractor for out-of-pocket expend-
itures in the amount of $608.40.
BE IT FURTHER RESOLVED that the City Manager be and is
hereby authorized and directed to carry out the cancellation of
the contract as herein directed.
