RESOLUTION NO. 53231
A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH.ABANDONING A WATER RESERVOIR AND
A PORTION OF. A_PIPELINE EASEMENT AND AUTHORIZING
A QUITCLAIM.DEED.
WHEREAS, The Irvine Company, a corporation, by an inden-
ture dated August 22, 1924, granted certain real property to the
City of Newport Beach for the purpose of constructing and maintain -
ing a water reservoir thereon and granted.an easement to the City
of Newport Beach by the same instrument for the purpose of con-
structing and operating a water pipeline leading from said reser-
voir; and
WHEREAS, said indenture provides that, if the property
or the easement is abandoned or ceases to be used for the purpose
for which granted for a period of one year, the Cityls right should
(terminate and the property revert to the grantor or its successors
and assigns; and
WHEREAS, the City does not now and will not hereafter
need the reservoir that was constructed on said land to supply
water in the City and does not now and will not hereafter need a
portion of said easement for any purpose; and
WHEREAS, it would be for the best interests of the City
and the citizens thereof and in keeping with the terms of said
indenture to abandon the reservoir and a portion of said easement
as hereinafter provided and quitclaim the City's interest in the
property hereinafter described;
NOW, THEREFORE, BE IT RESOLVED that effective November
30, 1960, the City of Newport Beach abandon the City water resery
No. 4 and water reservoir No. 5 and that portion of the pipeline
easement hereinafter described.
BE IT FURTHER RESOLVED that the Mayor and -City Clerk be
and are hereby authorized and directed to execute and deliver a
quitclaim deed on November 30, 1960, quitclaiming.to The Irvine

Company, its successors and assigns, all the City's right, title

and interest in and to certain real property situated in the City

of Newport Beach, County of Orange, State of California, particu-
4
larly described as follows:

PARCEL 1.

All that piece or parcel of land being a portion of Block
93, of -a map of Irvine Subdivision as recorded in Miscel»
7
laneous Record Maps, Book 1, page 98 Records of Orange
County, California, described.as follows:

Beginning at the intersection of a line 4000 --feet
9
southeasterly of and parallel with the north-
westerly line of the aforesaid Block 93, and a
10
line 1700 feet northeasterly of and parallel
with the southwesterly line of the aforesaid Block
11
93; thence northeasterly along a line, which
line is 4000 feet southeasterly of and parallel
12
with the northwesterly line of the aforesaid Block
93, a distance of 200 feet to a point; thence
13
southeasterly along a line which line Le 1900
feet northeasterly of and parallel with the south -
14
westerly line of the aforesaid Block 93, a distance
of 300 feet to a point; thence - southwesterly

along a line, which line is 4300 feet southeaster-
ly of and parallel with the northwesterly line

of the aforesaid Block 93, a distance of 200 feet
to a point; thence northwesterly along a line

which line is 1700 feet northeasterly of and para-
llel with the southwesterly line of the afore -

said Block 93, a distance of 300 feet to the place
of beginning, containing 1.377 acres of land.

All that portion of the following described easement

lying northeasterly of the northeasterly boundary of
that certain parcel of land conveyed to the_Newport

Beach Elementary School District described in a deed
recorded in Book 2248, page 487, Official Records of

Orange County, California:
24 A strip of land being a portion of Block 93, of
Irvine Subdivision, as per map thereof recorded
25 in Book, -I, page 88, Miscellaneous Record Maps
of Orange County California; said strip of
26 land to be six (g) -feet in width and three (3)
feet in width on each side of the following
27j described centerline:
28 Beginning at the intersection of the northeast-
erly line of the Corona Del Mar Subdivision as
29 recorded in Miscellaneous Record_Maps, Book 3,
pa es 41 and 42, Records of Orange County,
30 California, and aline which line is fifteen
(15) feet southeasterly of and parallel with
31 the northwesterly line of Goldenrod Avenue
(formerly called 33rd Avenue) as said Golden -
32 rod Avenue (formerly called 33rd Avenue), is

laid out and shown upon the aforesaid map of
Corona Del Mar; thence northeasterly across
said Block 93 of a map of Irvine Subdivision
as recorded in Miscellaneous Record Maps Book 1,
page 88, records of Oran*e County, California,
along a line which line is fifteen (15) feet
southeasterly of and parallel with the_north-
westerly line of the aforesaid Goldenrod Avenue
(formerly called 33rd Avenue) a distance of seven-
teen hundred (1700) feet to a point.
7 BE IT FURTHER RESOLVED that the abandonment herein
8 declared is subject to the right of the City to salvage all per-
9 sonal property on the site between the date of this resolution
10 and November 30, 1960, and thereafter during the ninety (90) days
11 following November 30, 1960, while grading operations are in
12 progress in connection with the prospective development of the
13
14 ADOPTED at an adjourned regular meeting this 31st day of
15I October, 19600
