2'I A RESOLUTION OF THE CITY COUNCIL OF THE CITY
OF NEWPORT BEACH AUTHORIZING THE EXECUTION OF
3 A CONTRACT WITH THE.CITY OF COSTA MESA FOR THE
CONSTRUCTION OF DRAINAGE FACILITIES

5 WHEREAS, a watercourse exists in the vicinity of 23rd
6 Street and Irvine Avenue in the City of Newport Beach which
7 extends in a southerly direction to Newport Bay and in a northerly
8 direction into an area lying within the County of Orange and
9 further into an area within the boundary of the City of Costa
10 Mesa; and
11 WHEREAS, it is to the mutual advantage of the City of
121 Costa Mesa and the City of Newport Beach to cooperate on the
13 i1 acquisition of rights -Hof -sway and the construction of adequate
14 drainage facilities in said watercourse within the City of Newport
15 Beach; and

16 WHEREAS, a contract has been prepared between the City
17 of Costa Mesa and the City of Newport Beach under which the City
18 of Newport Beach will contribute the sum ofa$10,000 for the
19 acquisition of necessary rights- of-way and the construction of the
20I proposed facilities; and
21 WHEREAS, it appears to be in the best interests of the
22 City to execute said agreement;
23 NOW, THEREFORE, BE IT RESOLVED that said agreement be
24 approved on condition that it provide that the City's contribution
25 be limited to $10,000 plus one -half the amount the cost of the
26 rights -of -sway may exceed $10,000, and that the Mayor and City Cler
27 be and are hereby authorized to execute the same on behalf of the
28, I City of Newport Beach.
