2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH ACCEPTING A GRANT OF EASEMENT

4 WHEREAS, The Irvine Company, a West Virginia corporation
5 has executed a grant of easement granting to the City of Newport
6 Beach a non - exclusive easement for sanitary sewer purposes over
7 the following- described real property in the County of Orange,
8 State of California, to wit:
9 A strip of land 15.00 feet in width and 2,200 feet, more
or less, in length lying 7.50 feet on each side of the
10 following- described centerline:

Beginning at a point in the Southerly boundary of
Pacific View Drive, 40 feet wide as said Pacific

View Drive is-described in a deed recorded in Book
4143,.Page 395 of Official Records, records of

Orange County, California, said point being North-
west 7.50 feet when measured at right angles from
14
the Northwesterly boundary of an easement granted
to the Metropolitan Water District as said ease-
15
ment is described in a document recorded in Book
2402, Page 469 of Official Records, records of
16
said Orange County; thence Southeasterly 2200
feet more or less on a line parallel with and
17
Northwest 7.50 feet when measured at right angles
from said Northwesterly boundary of said Metro -
18
politan Water District easement, to an intersection
with the Northerly boundary of Tract 2202 and the
19
end of the herein described easement, as said Tract
2202 is shown on a map recorded in Book 123, Pages
20
22 to 26 inclusive of Miscellaneous. Maps, records of
said Orange County;

WHEREAS, said grant also recites as follows:

Vithout limiting the generality of the rights of the
Grantor under the non - exclusive easement granted
25
hereunder, there is hereby reserved unto the Grantor
and its successors and assigns the right to use said
26
strip of land for any purpose that does not interfere
with a reasonable use thereof by the Grantee, inclu-
27
ding the right to grade and surface and use said
strip of land for road purposes. In the event it
28
becomes necessary for the Grantee or its successors
or assigns to damage or injure any such surfacing in
29
the repair maintenance or replacement of any sewer
laid
pipe line in said easement the Grantee shall,
30
at its sole cost and expense, repair any such damage
or injury and restore the surface of such roadwayt1;

3211 VIHEREAS, it is to the interest of the City to accept

said grant of easement for such purposes;
NOW, THEREFORE, BE IT RESOLVED by the City Council of
the City of Newport Beach that said grant of easement be accepted
and the City Clerk is authorized and directed to execute and attach
a certificate of acceptance and consent to the recording in the
County Recorder's office of said grant of easement together with
the drawing attached thereto of The Irvine Company Engineering
Department dated 11- 30 -60, revised 8 -3 -61, designated by number
93- 360 -001, showing the location of said easement and detail they,
ADOPTED this Z ftZ day of x-1961.
