1 RESOLUTION NO. 5560
• 2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH DECLARING ITS INTENTION TO ANNEX
3 TO THE.CITY CERTAIN PROPERTY KNOWN-AS ANNEXATION
4 NO..50 AND GIVING.NOTICE_THEREOF.
5 WHEREAS, there is situated outside and contiguous to the
6 City of Newport Beach a certain uninhabited territory within the
7 meaning of the Annexation of Uninhabited Territory Act of 1939,
8 said territory being more particularly hereinafter described; and
9 WHEREAS, annexation to the City would make municipal ser,
10 vices available to the property owners and be for the best inter -
11 ests of said owners and the City of Newport Beach and its citizens,
12 and

WHEREAS, the City of Newport Beach as proponent, by the
14
Director of Public Works, did on or about the 16th day of February,
15
1962, submit to the Secretary of the Orange County Boundary Com-
16
mission a legal description and plat of the hereinafter described
17
uninhabited territory for its report, and filed said plat with the
18
Registrar of Voters, pursuant to the provisions of Section 35002
19
of the Government Code of the State of California; and
20
WHEREAS, on the 12th day of March, 1962, there was filed
21
with the City Clerk of the City of Newport Beach a report of said
22
Orange County Boundary Commission pursuant to the provisions of
23
Section 35002 of.the Government Code of the State of California;
24
NOW, THEREFORE, BE IT RESOLVED by the City Council of
25
the City of Newport Beach that proceedings are hereby initiated by
26
the City of Newport Beach to annex the said territory hereinafter
27
described, which territory is contiguous to the present boundaries
28
of said City and which said territory now is uninhabited within the
29
meaning of the Annexation of Uninhabited Territory Act of 1939 and
30
that the reasons for said annexation are that it would make munici-
31
pal services available to the property owners and be in the best
32
interests of said owners and the City of Newport Beach and its

•citizens that said City annex said territory.

NOTICE IS HEREBY GIVEN that it is proposed by said City
3
of Newport Beach to annex said hereinafter described territory to
4
said City, which said territory shall in these proceedings bear the
5
name of "ANNEXATION NO. 50 ". The specific description of the
6
boundaries of the territory so proposed to be annexed is attached
7
hereto, marked Exhibit "A ", and by reference made a part hereof.

FURTHER NOTICE IS HEREBY GIVEN that on Monday, the 23rd
9
day of April, 1962, at the hour of 7:30 P. M. on said day, or as
10
soon thereafter as the matter may be heard, in the Council Chamber
11
of the City Hall of the City of Newport Beach, 3300 Newport Boule-
12
vard, Newport Beach, California, a hearing will be had, at which
13
hearing the City Council shall hear and pass upon all written
14
protests filed at any time prior to the final adjournment of the
15
hearing by any person owning real property within the territory
16
proposed to be annexed, and at any time prior to said final adjourn -
17
ment any owner of property within the territory proposed to be
18
annexed may file a written protest against the annexation. The
19
protest shall set forth the name of the owner of the property
20
affected and give the street address or other description of the
21
said property sufficient to identify It on the last equalized
22
assessment roll.

The City Clerk of the City of Newport Beach is hereby
24
authorized and directed to cause a copy of this resolution to be
25
published once a week for two weeks, said publication to be complete
26
at least twenty (20) days prior to the date set for the hearing,

and the publication shall be in the official newspaper of the City,
28
which is a newspaper of general circulation printed and published

In the City of Newport Beach, and in the 619be- Herald & Pilot, a

newspaper of general circulation printed and published in the
31
County of Orange and outside the City of Newport Beach.

The City Clerk is further authorized and directed to mail

a notice of the proposed annexation to the Board of Supervisors of
Orange County and to all persons to whom land proposed to be annexe
is assessed in the last available equalized assessment roll, at the
address shown thereon or as known to said City Clerk, and to others
who have requested the same in accordance with the provisions of
the Annexation of Uninhabited Territory Act of 1939 as amended.
