2 A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF
NEWPORT BEACH AUTHORIZING THE EXECUTION OF AN
3I AMENDMENT TO A SUBDIVISION AGREEMENT

511 WHEREAS, Pacific Electric Railway Company, as subdivider
611of Tract No. 3813, has agreed to install subdivision improvements inj
711accordance with an agreement dated the 11th day of January, 1962,
811within one year from the date thereof; and
911 WHEREAS, said agreement provides that the City Council
1011may extend the time for performance by the subdivider under said
1111agreement if it determines that the circumstances justify such
1211 extension of time; and
1311 WHEREAS, due to the conditions of the tract it has been
1411impossible to complete the improvements within the time required;

WHEREAS, it would be in the mutual interest of the parties
to extend the time within which said improvements must be completed;
and
WHEREAS, an amendment to said subdivision agreement has
been prepared under which the time for completion of said improve-
Iments would be extended to June 1, 1963; and
WHEREAS, the City Council has reviewed the terms of the
proposed amendment and found them to be acceptable;
NOW, THEREFORE, BE IT RESOLVED that the Mayor and City
lClerk be and are hereby authorized and directed to execute said
amendment on behalf of the City of Newport Beach.
