RESOLUTION NO. J_ S_b
A RESOLUTION OF THE CITY COUNCIL OF THE.CITY OF
NEWPORT BEACH SETTING A PUBLIC HEARING TO CONSIDER
THE EXCLUSION OF CERTAIN UNINHABITED TERRITORY
WHEREAS, the City Council by Resolution No. 5754 initiated
proceedings to exclude certain uninhabited territory from the City,
being a portion of territory annexed to the City as uninhabited
territory; and
WHEREAS, a specific legal description of said territory
to be excluded and a map thereof have been submitted to the County
Boundary Commission for a report on the definiteness and certainty
of the boundaries thereof; and
WHEREAS, said County Boundary Commission has made a
report approving the boundaries; and
WHEREAS, Section 35561.4 of the Government Code requires
the City Council to set a public hearing to consider the proposed
exclusion;
NOW9 THEREFORE, BE IT RESOLVED that a public hearing is
hereby set on April 8, 1963, at 7 :30 P.M. in the Council Chamber
of the Newport Beach City Hall at 3300 Newport Boulevard, Newport
Beach, California, to consider the exclusion from the City of
Newport Beach of certain uninhabited territory particularly de-
scribed as follows, to wit:
That portion of lot 139, block 50 of Irvine's Subdivision
in the City of Newport Beach, County of Orange, State of
California, as said subdivision is shown on a map recorded
in Book 1, page 88 of Miscellaneous Record Maps in the
office of the County Recorder of said county described as
follows:
Commencing at the most northerly corner of Tract No. 3201
as per map recorded in Book 130, pages 25 to 30 inclusive,
of Miscellaneous Maps, records of Orange County; thence
North 39° 48' 15" East 108.82 feet along the southeasterly
• right of way line of Acacia Street, 70 feet wide, as shown
on said tract map, said southeasterly right of way line
being also the northwesterly line of the Acacia Street Annex
to the City of Newport Beach as described in Ordinance No.
837 of said city to an intersection with a non - tangent curve
concave southeasterly having a radius of 1200 feet, said
intersection being the true point of beginning, a radial to
said point bears North 35° 21' 39" West; thence continuing
North 390 48' 15" East 377658 feet along said southeasterly
right of way line and said northwesterly line of the Acacia
Street Annex to an intersection with the westerly right of
way line of MacArthur Boulevard, 110 feet wide, as described
in a deed recorded in Book 1047, page 557 of Official Records,
records of Orange County; thence South 70 50' 38" East 150.49
feet along said westerly right of way line being also the
easterly line of said Acacia Street Annex to an intersection
with said non - tangent curve concave southeasterly having a
radius of 1200 feet, a radial to said intersection bears
North 21° 07° 16" West; thence leaving said westerly right
of way line and said easterly line of the Acacia Street
Annex, southwesterly 298.24 feet along said curve through an
angle of 14° 14° 23' to the true point of beginning.
BE IT FURTHER RESOLVED that the City Clerk is hereby
ordered and directed to publish a notice of said hearing for two
successive weeks in the official newspaper of the City and to mail
a copy thereof to the Board of Supervisors of the County of Orange
and to all owners of property within the territory proposed to be
excluded as shown on the last equalized assessment roll.
ADOPTED this 25th day of March, 1963.
